Explanation
Background: This legislation authorizes the Public Service Director to modify and increase a Reimbursement Agreement with Empire Ventures/6200 E. Broad Street, LLC ("Continental") an additional $540,950.00 for the final design of improvements along the East Broad Street corridor and $114,200.00 for the final design of improvements and right of way at the intersection of Reynoldsburg/New Albany Road and East Broad Street. The projects are designated in Exhibit D in the Tax Increment Financing Agreement for East Broad Street. Final Design will be provided for the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road. Services are detailed in the Consultants letter dated June 23, 2006. The formal competitive bidding requirements of Chapter 329 of the City Code are being waived for the procurement of final engineering services pursuant to this Reimbursement Agreement.
The original contract amount was $446,050.00. The amount of this modification is $655,150.00. The total of all modifications is $655,150.00. The contract amount, including all modifications is $1,101,200.00.
Empire Ventures/6200 E. Broad Street, LLC ("Continental") has the contract compliance number 200435822 and it expires on 7/16/09.
Fiscal Impact: Funds for this project are budgeted and available within the 2006 CIB in the 1995, 1999, 2004 Voted Streets and Highways Fund.
Emergency action is requested so that this project can proceed in a timely manner and keep commitments made to the local community. Final Engineering was partially funded and in progress. It is necessary to set up these additional funds to fund the remaining Final Engineering.

WHEREAS, the need exists to modify and increase the Reimbursement Agreement for the final design of the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road and the final design for the intersection of Reynoldsburg/New Albany Road and East Broad Street, and
WHEREAS, it is in the best interest of the city to waive the formal competitive bidding requirements of the Columbus City Code, 1959, and that this agreement be awarded in accordance with Section 186 of the Columbus City Charter, and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department in that it is immediately necessary to provide consent for these projects so it can proceed according to established timelines, thereby preserving the public health, peace, property, safety and welfare; now, therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Public Service Director be and is hereby authorized to modify and increase the Reimbursement Agreement with Empire Ventures/6200 E. Broad Street, LLC ("Continental") for the final design of the East Broad Street Median Project from I-270 to Reynoldsburg-New Albany Road and for the final design for the intersection of Reynoldsburg/New Albany Road and East Broad Street for the Transportation Division in the amounts of $540,950.00 and $114,200.00 pursuant to Section 186 of the Columbus City Charter.
SECTION 2. That in accordance with Section 329.27 of the Columbus City Code, City Council has determined that it is in the best interest of the City of Columbus that the formal competitive bidding requirements of Chapter 329 be and are hereby waived for the procurement of final engineering services pursuant to this Reimbursement Agreement.
SECTION 3. That the expenditure of $655,150.00, or so much thereof as may be necessary be and is hereby authorized and approved as follows:

SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That for the reasons stated in the preamble hereto which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
