Explanation
 
This ordinance authorizes the intra-fund transfer of $19,000.00 within the Facilities Management Capital Improvement Fund from the Unallocated Facilities Renovation Project to the Municipal Court Renovation Prosecutors/Probation project, and authorizes the Public Service Director to modify contract EL900639 with J.L. Bender, Inc. for professional services associated with renovation of the floors (7, 8, 17, and 18) occupied by the Prosecutor and Probation Offices at the Franklin County Municipal Court Building.  Ordinance No. 1332-99 authorized the original contract with J.L. Bender in the amount of $24,800.00
 
Currently, the City Prosecutor's office occupies the 7th floor and part of the 17th floor at the Franklin County Municipal Court Building and the Probation office occupies the 8th floor and part of the 17th floor at the same facility.  The 17th and 18th floors are also used for records storage and temporary office space.  This modification is necessary due to additional time needed to adjust designs in the schematic phase and a change in the original scope of the work.  In addition, J.L. Bender's costs for staff, insurance, and consultants have increased.  The modification also includes  design work, preparation of contract specifications, bidding assistance, and construction administration.
 
EMERGENCY action is requested to allow the project to move forward as soon as possible.
 
FISCAL IMPACT:  $20,560 is available in the Unallocated Balance for Facility Renovations in the Facilities Management Capital Improvement Fund.  This ordinance amends the 2002 Capital Improvements Budget in order to complete the transfer of funds and modify the dollar amount of the existing contract with J.L. Bender.

WHEREAS, a contract was originally authorized by Ordinance 1332-99 with J.L. Bender for professional services associated with the renovation of floors 7, 8, 17, and 18 of the Franklin County Municipal Court Building; and
 
WHEREAS, it is necessary to transfer funds within Facilities Management Capital Improvement Fund; and
 
WHEREAS, it is necessary to modify the contract with J.L. Bender for professional design services to renovate floors 7, 8, 17,a nd 18 of the Franklin County Municipal Court Building; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Facilities Management Division, in that it is immediately necessary to modify a contract with J.L. Bender for professional services associated with the renovation of floors 7, 8, 17, and 18 of the Franklin County Municipal Court Building, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the City Auditor is hereby authorized and directed to appropriate and transfer funds within the Facilities Management Division Capital Improvement Fund as follows:
