Explanation
 
The Public Service Department, Transportation Division, recently received a request from Erin Nyrop asking that the City release all of the platted utility easement located between Lots 215 and 216 as shown on the plat titled Northmoor Subdivision, of record in Plat Book 14, Page 18, of the Franklin County, Ohio Recorder's Office.  In 2003 Ms. Nyrop engaged an architect and a construction company to enlarge her home at 280 Montrose Way.  Her original home was located entirely on Lot 215 of the Northmoor Subdivision but the addition extended across and onto Lot 216.  During construction of the addition Ms. Nyrop, the architect, and the construction company worked with the various utilities to relocate their facilities out of the easement and around the addition.  Ms. Nyrop did not however, formally request the City release the platted utility easement at that time.  When Ms. Nyrop recently made her official request to have this easement released, she was in contract to sell her home to Mary Beth Breckenridge and as a condition of the sale was required to begin the process of having this platted easement formally released.  After receipt of Ms. Nyrop's request the Transportation Division verified with all the public and private utility companies that there are no longer any utilities located within the portion of this platted easement between Lots 215 and 216 and that they have no objections to the release of this portion of the platted easement.  A value of $500.00 was established for the release of this portion of the platted easement.  The following legislation authorizes the Public Service Director to execute those documents necessary to release of the portion of this platted easement between Lots 215 and 216 of the Northmoor Subdivision.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the release of that portion of the platted easement between Lots 215 and 216 of the Northmoor Subdivision.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Erin Nyrop asking that the City release that portion of a platted utility easement located between Lots 215 and 216 as shown on the plat titled Northmoor Subdivision, of record in Plat Book 14, Page 18, of the Franklin County, Ohio Recorder's Office; and
 
WHEREAS, in 2003 Ms. Nyrop engaged an architect and a construction company to enlarge her home at 280 Montorse Way; and
 
WHEREAS, her original home was located entirely on Lot 215 of the Northmoor Subdivision but the addition extended across and onto Lot 216; and

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Public Service Director be and is hereby authorized to execute those documents necessary to release that portion of the platted utility easement located between Lots 215 and 216 of the Northmoor Subdivision, of record in Plat Book 14, Page 18 of the Franklin County, Ohio, Recorder's Office.
 
Section 2.  That the $500.00 to be received by the City as consideration for the above referenced release shall be deposited in Fund 748, Project 537650.
 
Section 3.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
