Explanation

 

1.  BACKGROUND:

The purpose of this ordinance is to amend Ordinance No. 0633-2009 in order to establish funding in the correct  Object Level within the Street Construction Maintenance and Repair Fund.  This ordinance is necessary to provide sufficient authority for the purchase of brine storage tanks and equipment at the Department of Public Service, Division of Planning and Operations Outposts.  Brine is a mixture of salt and water that is used to pre-treat roadways for the purpose of reducing the effects of snow and ice events.  

 

The purpose of ordinance 0633-2009, was to appropriate funds to provide for facility renovations and improvements.  The City received a grant from the Federal Emergency Management Agency for expenses that occurred during the windstorm in September of 2008.  Ordinance 0633-2009 appropriated those funds for the purpose of performing facility upgrades and repairs involved to correct these deficiencies. 

 

2. FISCAL IMPACT

This ordinance will establish funding in the correct Object Level Code necessary to purchase brine storage tanks and equipment at several Division of Planning and Operations facilities.

 

3.  EMERGENCY DESIGNATION

Emergency action is requested so that these storage tanks can be in place for the upcoming  winter season.

 

Title

To amend ordinance 0633-2009 to authorize the City Auditor to modify the authority requested in said ordinance to provide for the purchase of brine storage tanks and equipment for the upcoming winter season; and to declare an emergency.  ($369,472.00)

 

Body

WHEREAS, ordinance 0633-2009 authorized the appropriation of monies to the Street Construction Maintenance and Repair Fund for the purpose of providing funding for Division of Planning and Operations for facility renovation needs; and

 

WHEREAS, after the passage of this ordinance it was determined that part of this appropriation should have been authorized to the object level code established for the acquisition of equipment for the purchase of brine storage tanks and equipment from the Street Construction Maintenance and Repair Fund; and

 

WHEREAS, it is necessary to amend ordinance 0633-2009 for the above described purpose; and

 

WHEREAS, an emergency exists in the usual daily operation of the Division of Planning and Operations in that this amendment should be authorized immediately to provide brine storage tanks and equipment for the Division of Planning and Operations so that  the Division will have means to effectively pre-treat roadways for the upcoming winter season, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.  That Ordinance 0633-2009 be and hereby is amended as follows:

 

Section 1.   That the amount of $369,472.00  is hereby transferred from the General Government Grant Fund, Fund 220, Grant 459087, Dept 45,  OL3 5501 to the unappropriated balance of the Street Construction Maintenance and Repair Fund as follows:

Section 2.  That the sum of $369,472.00 be and hereby is appropriated from the unappropriated balance of Fund 265, the Street Construction, Maintenance and Repair Fund, from any and all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2009, to the Division of Planning and Operations, Dept.-Div. 59-11, Minor Object Code 3370 ($319,472.00) and 6651 ($50,000.00) and OCA Code 591117.

 

Section 3.  That the monies appropriated in Sections 2 shall be paid upon order of the Director of Public Service and  that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

Section 4.  That the City Auditor be and hereby is directed to establish an Auditor's Certificate in the amount of $369,472.00 to fund necessary Division of Planning and Operations facility renovation projects, of which the expenditure will be authorized incrementally from this Auditor's Certificate as the projects are bid and awarded for these facility improvements.

Section 5.  That all contracts will be issued in accordance with the provisions of the City Codes, 1959.

 

Section 6.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.

 

Section 2.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
