Explanation
BACKGROUND: This ordinance authorizes the Finance and Management Director to modify and renew a contract with Kone, Inc. for the maintenance of elevators in various city buildings in the amount of $168,000.00 for the Facilities Management Division, covering the period of August 1, 2007, through July 31, 2008. The renewal will cover forty-one elevators. This contract was first authorized by City Council on July 22, 2003, by Ordinance No. 1051-2003, in the amount of $122,656.11. It was renewed by Ordinance 1025-2004, passed June 23, 2004, in the amount of $142,000.00; Ordinance 1236-2005, passed July 27, 2005, in the amount of $153,000.00; and, Ordinance 1111-2006, passed June 28, 2006, in the amount of $169,104.00. The original contract has four renewal options. This modification exercises the fourth of the four renewal options. This contract will cover the normal year-to-year maintenance.
Emergency action is requested so that the service agreement can renew by August 1, 2007, thereby protecting the safety of elevator users.
Fiscal Impact: The contract modification will cost $168,000.00, including a contingency of $12,852.00. The Facilities Management Division budgeted $168,000.00 for this expense in 2007. Kone, Inc. Contract Compliance Number 36-2357423, exp. 07/13/2008.

WHEREAS, Ordinance No.1051-2003, passed by City Council on July 22, 2003, authorized the Public Service Director to enter into contract with Kone, Inc. for the maintenance and service of elevators, and
WHEREAS, Ordinance No.1025-2004, passed by City Council on June 23, 2004, authorized the Public Service Director to modify and renew said contract, and
WHEREAS, Ordinance No.1236-2005, passed by City Council on July 27, 2005, authorized the Public Service Director to modify and renew said contract, and
WHEREAS, Ordinance No.1111-2006, passed by City Council on June 28, 2006, authorized the Finance and Management Director to modify and renew said contract, and
WHEREAS, the contract with Kone, Inc. contains an option to renew the existing agreement for four one-year periods, and
WHEREAS, it is necessary to renew and modify this contract with Kone, Inc., and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Facilities Management Division, in that it is immediately necessary to authorize the Finance and Management Director to renew and modify a contract with Kone, Inc. for the maintenance and service of elevators as soon as possible, thereby preserving the public health, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to renew and modify a contract with Kone, Inc. for maintenance and service of elevators for the Facilities Management Division, for the period of August 1, 2007 to July 31, 2008.
SECTION 2. That the expenditure of $168,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 4. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves or vetoes the same.
