APPLICANT:  Stefanie Steward-Young; 2570 Berwick Boulevard; Columbus, OH  43209.
 
PROPOSED USE:  Commercial development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on August 11, 2005.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested L-C-4, Limited Commercial District will allow limited commercial development consistent with the established zoning and development patterns of the area.  The limitation overlay text establishes appropriate use restrictions and incorporates applicable Northland Development Standards addressing access, landscaping, and lighting and graphics controls.

WHEREAS, application #Z05-037 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.17± acres from the C-2, Commercial District to L-C-4, Limited Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance to begin construction as soon as possible for the immediate preservation of the public peace, property, health and safety; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-C-4, Limited Commercial District will allow limited commercial development consistent with the established zoning and development patterns of the area.  The limitation overlay text establishes appropriate use restrictions and incorporates applicable Northland Development Standards addressing access, landscaping, and lighting and graphics controls, now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situated in the County of Franklin, in the State of Ohio, and in the City of Columbus and bounded and described as follows:
 
Being in Quarter Township 2, Township 1, Range 17, United Stated Military Land, and bounded and described as follows:
 
Beginning at a point in the center line of Morse Road, S. 85 degrees 0'E 1,695 feet from a point where the center line of said road would intersect the center line of Cleveland Avenue; thence along the center line of Morse Road,  S. 85 degrees 0'E. 50 feet to a point; thence S. 4 degrees 41'W. (passing an iron pin at 30 feet) 200 feet to an iron pin; thence N. 85 degrees W. 50 feet to an iron pipe; thence N. 4 degrees 41'E. 1. INTRODUCTION:  This property is situated in the County of Franklin, in the State of Ohio and in the City of Columbus.
 
Current uses:  The current property is vacant.  The property is currently zoned C2.  All C-2 uses as listed in Section 3353.03 of the Columbus City Code are currently permitted.
 
Surrounding uses in each direction and zoning districts:  All adjacent / surrounding properties are zoned C-4, except for one neighboring property located on the west side of the subject property.  Surrounding businesses are as follows: West - U-Haul Rental, East - Auto Repair, South - Storage Facility, North - Apartments
 
Acreage:  .166 acreage
 
2. PERMITTED USES:  All C4 uses as listed in Section 3356.03 of the Columbus City Code.
 
The following uses are prohibited:  Hotels and Motels; Hospitals; Dwelling units; Halfway Houses; Automobile, Truck, Motorcycle, Boat, and other Motor Vehicle Sales, Leasing, or Rental; Bars, Cabarets, and Nightclubs; Check Cashing and Loans; Pawn Brokers; Tattoo and/or Piercing Businesses; Billboards; Radio, Television or Cell Phone Towers.
 
3. DEVELOPMENT STANDARDS:  
         
A. Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
1.      All circulation, curb cuts and access points shall be subject to the approval of the Division of Transportation.
 
2.      Sidewalks shall be provided on all streets to enable residents to walk safely within the community.  Design, placement, and applicability may vary with road type.  Along arterial and collector streets, sidewalks on both sides of the street are required.  Exceptions may be considered where potential for foot traffic is unlikely, or would create a safety hazard, as determined by the Planning Division, Department of Development.
 
3.      In the case of a sidewalk immediately adjacent to pull-in parking bays, either the sidewalk should be widened to six (6) feet to allow for the overhang of parked cars, or wheel stops two and a half (2.5) feet from the sidewalk should be added.
 
B. Buffering, Landscaping, Open Space, and/or Screening Commitments.
1.      Loading areas shall be fully screened by structures and/or landscaping to a minimum height of six (6) feet, except when such loading areas shall not be visible to the public.
 
2.      All propane tanks, recycling stations, and outdoor trash containers shall be screened by a combination of structures and landscaping and shall meet all fire and safety design standards.  
 
3.      Headlights of cars shall be screened from adjacent property and streets.  Such screening may be accomplished by the use of shrubs, landscaped mounding, low brick or stone walls, topographical differences or combination thereof.  The height of screening shall be 30 inches.  Such screening shall not obstruct the vision of cars entering or exiting the site.
 
4.      One tree shall be provided for every ten parking spaces.  Trees will also be planted in islands at the end of every parking aisle.  At no less than every fourth parking aisle, a row of trees spaced on one tree per forty linear feet shall be planted in a median at least five feet wide.  In smaller lots, not exceeding two parking aisles, trees may be on the periphery of the lot.  Tree species shall be selected and planted in a manner that does not obstruct motorist vision.  Within parking areas trees should be placed in islands at least five feet wide.  
 
C. Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.    For general lighting areas including parking lots, down lighting is required.  However, for less intense pedestrian level lighting, not more than 4,000 lumens, globe lighting may be appropriate.
 
2.      All external outdoor lighting fixtures within a given development shall be from the same or similar manufacturer's type to insure aesthetic compatibility.
 
3.      Light poles shall not exceed twenty-eight (28) feet in height.
 
D. Graphics and/or Signage Commitments.
 
1.      All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code and the Morse Road Special Graphics Control Area, 3380.101 H.  Any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
2.      There shall be no floodlighting of elevated signs.  High intensity searchlights used for advertising purposes shall also be excluded.
 
3.      Ground mounted illumination shall be concealed from view of the public right of way and adjacent properties by a landscape screen of low shrubs or equivalent.
 
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
