.1.  NEED:
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a professional engineering services contract with R. D. Zande & Associates, Inc. in connection with the Sanitary Sewer System I/I Remediation-Early Ditch Project.
 
The Early Ditch project is primarily located in the City's Hilltop community, and encompasses approximately 4000 acres with about 12,018 residential parcles, 20 industrial facilities; 794 commerical services, 273 parcels designated for public and private use.  This area has had a significant number of street, yard, and basement flooding during rain events for decades.  In addition, the sanitary sewers are suspected to surcharge, causing backups in basements, and overflows to the environment.
 
This contract will provide the preliminary engineering services required to perform a comprehensive investigation and evaluation of the areas sanitary and stormwater collection systems.  This will include field verification, cleaning and insitu-video inspection of all sanitary infrastructure, and incorporating this information into the division's computerized hydraulic model of the Early Ditch area.  An evaluation of this information will identify cost effective immediate and long-term stormwater and sanitary system improvement recommendations, operation and maintenance practices, guidelines for implementing recommendations for private property improvements.
 
2.  PROCUREMENT INFORMATION:
The basis for selection of the chosen professional engineering services firm: The Division advertised Request for Statement of Qualifications (RFSQ's) for                                                                       five of the sanitary sewer Inflow/Infiltration remediation projects in the City Bulletin in accordance with the provisions of Section 329.13 of Columbus City Codes.  Six of the ten submitting firms were short-listed and were requested to submit technical proposals for this project.  These proposals were reviewed and ranked by a Professional Engineering Services Selection Committee in order to determine the consultant best qualified to provide the services for this project.  The Division of Sewerage and Drainage received technical proposals on February 8, 2005 from R.D. Zande & Associates; Burgess & Niple, Inc., and URS Corporation, Inc.  The committee ranked the proposals on quality and feasibility.  After careful consideration, the committee recommended that R. D. Zande & Associates, Inc., be selected to provide the engineering services for the subject project, for which the Director of Public Utilities has concurred.
 
3.  PROJECT SCHEDULE:
All of the services performed under this contract will be accomplished within 24 months of the commencement.
 
4.  FISCAL IMPACT:
This ordinance requests the appropriation of planning loan proceeds from the Ohio Water Pollution Control Loan Fund in order to fund this proposed expenditure.  The Division anticipates seeking additional loans in the future in order to fund the planned infrastructure projects that will be recommended under this contract.

Body
WHEREAS, the Director of the Public Utilities received technical proposals from professional engineering service firms who were interested in providing services for the Sanitary Sewer System Inflow & Infiltration-Early Ditch Project, from the firms of R. D. Zande & Associates, Inc., URS Corporation, Inc., and Burgess & Niple, Inc., for the aforementioned project services; and received these proposals on February 8, 2005; in accordance with the procurement provisions of Section 329.13 of the Columbus City Codes; and
 
WHEREAS, based upon an evaluation of these proposals utilizing predetermined criteria, a selection committee determined that R. D. Zande & Associates, Inc., submitted the best proposal for the required project services; and
 
WHEREAS, the Ohio Water Development Authority (OWDA) approved a design loan to the City of Columbus on March 30, 2006, in the principal amount of $6,628,698.00, identified as OWDA Loan Number 4466, for the above listed project with eligible costs to include the entire professional engineering agreement referenced herein; and;
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage Department of Public Utilities, in that is it  is immediately necessary to pass this ordinance as an emergency measure because it has been determined necessary for this Council to authorize the Director of Public Utilities to award a professional engineering services contract for purposes of providing the aforementioned services; to authorize the appropriation and expenditure of funds from the Water Pollution Control Loan Fund; and to amend the 2005 Capital Improvements Budget, in order to proceed with the design services that are necessary to construct the infrastructure that will significantly reduce the City of Columbus's single, largest point of combined sewer overflow, for the preservation of the public health, peace, property, safety, and welfare; at the earliest practicable date, now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. 4466, for the Sanitary Sewer System Inflow & Infiltration-Early Ditch Project; and funds from the unappropriated monies in Fund No. 666, the amount of $6,628,698.00 for the cost of a professional engineering services contract, shall hereby be appropriated to the Division of Sewerage and Drainage as follows:

Section 2.  That the Director of Public Utilities be, and hereby is, authorized to enter into a professional engineering services contract with R. D. Zande & Associates, Inc., Inc., 1500 Lake Shore Drive, Suite 100, Columbus, Ohio 43204, in connection with the capital improvements projects identified within Section 3 herein, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Sewer System Engineering Section.
 
Section 3.  That the expenditure of $6,628,698.00, or as much thereof as may be needed, be and the same hereby is authorized from the Ohio Water Pollution Control Loan Fund No. 666; Division 60-05; within the following project:

Section 4.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, in order to provide sufficient budget authority for the execution of a professional engineering service contract award as referenced in the preamble hereto:
