Title: To authorize the Director of the Department of Finance and Management to amend the existing lease with Jaeger Commerce Park Ltd. Partnership to provide for a four (4) month lease renewal and reduce the size of the leased space from 24,000 to 9,408 square feet for continued occupancy by the Department of Public Safety; to authorize the expenditure of $15,209.60 from the Special Income Tax Fund; and to declare an emergency.
Explanation
 
BACKGROUND: The Division of Police has occupied space in the Jaeger Commerce Center, at 560 Nationwide Boulevard, since 1996. Upon expiration of the existing lease on May 7, 2008, a new lease was negotiated and approved by City Council (0752-2008). The new lease was for a three (3) month term and provided for a three (3) month renewal option to allow the City time to complete construction and renovations at several  City-owned buildings for occupancy by the various Divisions units housed in the leased space at 560 Nationwide. One of the locations to be renovated  that was expected to be ready for occupancy in August, encountered a delay that will push back occupancy until late November. The original three month renewal will not provide adequate time for the new premises to be ready for occupancy.  The Lessor has agreed to amend the existing lease to allow a four month extension and to reduce the size of the leased space.
 
This legislation will allow the Director of Finance and Management, on behalf of the Department of Public Safety, to execute those documents necessary to amend the lease to extend the lease renewal to a four (4) month term and to decerease the size of the leased space. Authorization is requested to amend and extend the lease to provide for a four (4) month renewal term that shall expire December 7, 2008 and to decrease the space leased from 24,000 square feet to 9,408 square feet. Monthly rent for the renewal term will decrease from $9,700 to $3,802.40. Total cost of  the four month renewal term will be $15,209.60.
 
Emergency action is requested to allow immediate commencement of the lease renewal and to provide funding for the beginning date of the lease renewal.  
 
Fiscal Impact:  This ordinance authorizes the expenditure of $15,209.60 from the Special Income Tax Fund appropriated through Ordinance 0075-2008, passed February 11, 2008 to Jaeger Commerce Park Ltd. Partnership Contract Compliance Number 31-1244129, expiration date 02/01/2009.

Body
 
WHEREAS, the Finance and Management Department, Office of Real Estate Management, has the responsibility for managing various leases for General Fund agencies, and
 
WHEREAS, the Departments of Public Safety and Development request the execution of this lease amendment and renewal, and
 
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Office of Real Estate Management, in that it is immediately necessary to authorize the Finance and Management Director to execute this lease agreement in order to provide funding for rental of office space for the Department of Public Safety to coincide with the beginning of the lease term, thereby preserving the public health, peace, property, safety and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:  
 
SECTION 1.  That the Director of the Department of Finance and Management be, and hereby is, authorized to execute those documents as approved by the Department of Law, Division of Real Estate, necessary to amend the existing lease agreement by and between the Jaegar Commerce Center "Landlord" and the City of Columbus, Ohio as "Tenant" to provide for a four (4) month lease renewal and reduce the leased space to 9,408 square feet.
 
SECTION 2.  That the terms and conditions of the lease amendment shall be in a form approved by the City Attorney's Office and shall include the following:
 
a)      The lease renewal shall be four monthscommencing on August 8, 2008 and terminating on December 7, 2008.
b)      The leased space for the renewal term shall be 9,408 square feet.
c)       Subject to appropriation of funds by Columbus City Council, the Lessee agrees to pay Lessor monthly rent payments of $3,802.40 for a total term rental of $15,209.60. The rental rate for the renewal period shall be the same as the initial rental rate.
d)            Such other terms and conditions as agreed to and approved by the City Attorney.
 
SECTION 3.  That the expenditure of $15,209.60, or so much thereof that may be necessary, is hereby authorized and approved as follows:

SECTION 4.  That the City Auditor is authorized to make any changes to revise the funding source for any contract or contract modifications associated with this ordinance.
 
SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
