Title: To authorize the Director of the Department of Recreation and Parks to execute a Quitclaim Deed of Easement and any ancillary documents necessary to grant certain easements to the Columbia Gas of Ohio Inc. for the purpose of providing gas services to a new club house located on the Columbus Zoo's Safari Golf Course, and to the extent they may be applicable, to waive the competitive bidding and Land Review Commission requirements of the Columbus City Codes (1959) Revised, and to declare an emergency.
Explanation
 
Background:  The City of Columbus ("City"), and the Franklin County Commissioners ("County") desires to grant the Columbia Gas of Ohio Inc. a certain easement for the purpose of an underground gas pipeline to that jointly owned City and County property commonly known as the Columbus Zoo.  The easement will allow the gas company to provide gas service to a newly built clubhouse located at the Zoo's Safari Golf Course.  After investigation, the Department of Recreation and Parks and the Department of Public Utilities have determined that the gas service provided to Zoo will benefit the City and should be granted at no charge.  The following legislation authorizes the Director of the Department of Recreation and Parks to execute those instruments necessary to grant the subject easements on the behalf of the City and County.

Emergency Justification:  Emergency action is requested as not to delay the benefit to the City, which will result from the proposed gas services provided to the Columbus Zoo.

WHEREAS,      The City of Columbus ("City"), the Franklin County Commissioners ("County") are joint owners of that real property commonly known as the Columbus Zoo; and
 
WHEREAS,      The City of Columbus ("City"), the Franklin County Commissioners ("County") desire to grant the Columbia Gas of Ohio Inc. certain easements for the purpose of extending a gas service line to a new clubhouse located at the Zoo's Safari Golf Course; and
 
WHEREAS,      after investigation, the Department of Recreation and Parks and the Department of Public Utilities have determined that the gas service provided to Zoo will benefit the City and should be granted at no charge; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City in that it is immediately necessary to authorize the Department of Recreation and Parks to immediately execute those instruments, prepared and approved by the Real Estate Division, Department of Law, necessary to grant certain easements to the Columbia Gas of Ohio Inc. in order to provide gas service to a new clubhouse located at the Zoo's Safari Golf Course, so as not to delay the resulting benefit to the City, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That the Director of the Department of Recreation and Parks be and hereby is authorized to execute those documents, as prepared and approved by the Real Estate Division, Department of Law, necessary to grant a perpetual non-exclusive easement in, under, across, over, and through the following described real property:
 
      Situated in the State of Ohio, County of Delaware, Township of Liberty, being out of a parcel of land known as Parcel Numbers 31934205002000 and 31933101012000, and being part of a tract of land conveyed to the City of Columbus and Franklin County Commissioners, Franklin County, Ohio (herein referred to as grantor) in Deed Volume 0030, Page 1436 & 1438; Deed Volume 0514, Page 448, and Deed Volume 0514, Page 453; of the Recorder's Office, Delaware County, Ohio, and being more particularly described as follows:
      Commencing for reference at the southeast corner of Farm Lot 13, also being the northeast corner of Farm Lot 15, the same being the southeast corner of a 25.397 acre tract of land conveyed to the grantors, thence N 02º 37' 34" E, along the east property line a distance of 106.59 feet to the Point Of Beginning of the easement described herein;
      Thence S 86º 25' 06" W, through the grantor's property for a distance of 73.16 feet to a point;
      Thence continuing through the grantor's property the following courses:
      N 86º 53' 22" W, for a distance of 280.86 feet to a point;
      N 81º 15' 03" W, for a distance of 147.71 feet to a point;
      S 86º 42' 25" W, for a distance of 110.91 feet to a point;
      S 47º 56' 29" W, for a distance of 80.23 feet to a point;
      S 09º 19' 21" W, for a distance of 480.17 feet to a point;
      S 10º 49' 43" W, for a distance of 177.46 feet to a point;
      S 17º 25' 43" W, for a distance of 188.70 feet to a point;
      N 72º 34' 17" W, for a distance of 20.00 feet to a point;
      N 17º 25' 43" E, for a distance of 187.54 feet to a point;
      N 10º 49' 43" E, for a distance of 176.05 feet to a point;
      N 09º 19' 21" E, for a distance of 486.91 feet to a point;
      N 47º 56' 29" E, for a distance of 94.28 feet to a point;
      N 86º 42' 25" E, for a distance of 120.05 feet to a point;
      S 81º 15' 03" E, for a distance of 148.83 feet to a point;
      S 86º 53' 22" E, for a distance of 278.71 feet to a point;
      N 86º 25' 06" E, for a distance of 74.17 feet to a point;
      
Thence S 02º 37' 34" W, along said east property line, for a distance of 20.12 feet to the Point Of Beginning, containing 0.710 acres, more or less.

      Section 2.      That this Council has determined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328 (Land Review Commission) and Section 329.29 (competitive bidding) to the extent that they may apply to this transaction with regards to this ordinance only.
 
      Section 3.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
