Explanation
Background
The Franklin County Municipal Court Clerk (hereinafter "Municipal Court Clerk ") was awarded an Urban Area Security Initiative Subcontract (hereinafter "UASI Subcontract") from the Franklin County Homeland Security and Justice Program. The UASI Subcontract is for the purchase of two years of maintenance and support services for two Livescan Fingerprint Units located at the Municipal Court Clerk's Office. These units allow defendants to be fingerprinted on location for immediate dispositions which will benefit Division of Police, Municipal Court Clerk's Office and the complete court system in better utilization and tracking of all information.

Emergency Designation: Emergency legislation is requested to expedite the process for the UASI Subcontract award for the continuity of maintenance and support services for the units.
Fiscal Impact: There is no fiscal impact on the general fund. The Intergovernmental Agreements permit the City of Columbus and Franklin County to make federal sub-grant expenditures and agreements per Ordinance 1691-2006 passed 10/18/06.

To authorize the Municipal Court Clerk to execute those documents necessary with MorphoTrak, Inc. for the purchase of maintenance and support services for Livescan Fingerprint Units, utilizing the Urban Area Security Initiative Subcontract, in accordance with the sole source procurement, and to declare an emergency. Body
Whereas, the Municipal Court Clerk was awarded a UASI Subcontract from the Franklin County Homeland Security and Justice Program to maintain and support the Livescan Fingerprint Units; and
Whereas, it is necessary to maintain and support the Livescan Fingerprint Units; and
Whereas, these units will allow defendants to be fingerprinted on location for immediate dispositions; and
Whereas, the fingerprint system is an invaluable tool to the law enforcement in the identification of fingerprints; and
Whereas, it is in the best interest of the City to enter into this contract in accordance with provisions of Section 329.07 (Sole Source) of the Columbus City Codes, 1959; and
Whereas, the Municipal Court Clerk is requesting to execute those documents necessary for the purchase of maintenance and support services for the Livescan Fingerprint Units utilizing the UASI Subcontract; and
Whereas, an emergency exists in the daily operation of the Municipal Court Clerk's Office in that it is immediately necessary to execute the needed documents for the purchase of maintenance and support services for the Livescan Fingerprint Units utilizing the UASI Subcontract thereby preserving the public peace, property, health, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Municipal Court Clerk be and is hereby authorized and directed to execute those documents necessary for the purchase of maintenance and support services for the Livescan Fingerprint Units with MorphoTrak, Inc. utilizing the UASI Subcontract.
Section 2. That said contract shall be awarded in accordance with provisions of Section 329.07(e) (Sole Source) of the Columbus City Codes, 1959.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
