BACKGROUND: This ordinance is being submitted to authorize the Director of Development to file a municipal annexation petition for a 47.2 acre site in Franklin Township, Franklin County generally referred to as the Cooper Stadium site. Annexation of this site will allow for its redevelopment within the city. Emphasis will be placed on job creation. Additionally, the ordinance provides for the acceptance of the property by the City of Columbus upon receipt of communication from the Franklin County Commissioners that they have approved the petition. This ordinance is required by the Ohio Revised Code as enacted by the General Assembly of the State of Ohio. Upon approval by City Council, a certified copy of this ordinance will be provided to the Franklin County Commissioners in conjunction with an annexation petition.
This ordinance is filed as emergency legislation in order to coordinate with Franklin County's efforts to redevelop the property.
FISCAL IMPACT: This ordinance has no direct fiscal impact. While the provision of the city services will represent a cost to the city, the intent of this annexation is to facilitate redevelopment which would generate revenue for the city.
Title
To authorize the Director of Development to file a municipal petition for the annexation of 47.2 acres within Franklin Township as provided in section 709.16 of the Ohio Revised Code and to provide for acceptance of the property by the City of Columbus upon approval of the petition by the Board of Franklin County Commissioners; and to declare an emergency.
Body
WHEREAS, the Columbus Clippers will be moving to a new stadium in downtown Columbus; and
WHEREAS, redevelopment of the existing stadium site with income producing uses that provide jobs for area residents is a community priority; and
WHEREAS, redevelopment of the site will be facilitated by its annexation into Columbus; and
WHEREAS, section 709.16 of the Ohio Revised Code allows for municipalities to file annexation petitions of territory owned by the municipality, a county or the state; and
WHEREAS, the City is able to provide municipal services to this site; and
WHEREAS, authorization by City Council is necessary for submission of a municipal annexation petition to the Board of Franklin County Commissioners; and
WHEREAS, upon receipt of the petition by the City to annex the site, the Board of Franklin County Commissioners must take action within 30 days; and
WHEREAS, whereas the City of Columbus desires to amend its boundaries by adding the territory associated with the existing Cooper Stadium if the petition is approved by the Board of Franklin County Commissioners ; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to present this ordinance to the Franklin County Board of Commissioners in accordance with the Ohio Revised Code to allow for timely coordination with the County regarding the redevelopment of this property; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the director of development is authorized to file a municipal petition for annexation as outlined in section 709.16 of the Ohio Revised Code of 47.2+/- acres in Franklin Township generally known as Cooper Stadium and described more specifically as follows:
Situated in the State of Ohio, County of Franklin, Township of Franklin, being a part of Virginia Military Survey No. 422, and being all of Lots 14, 15, 16, 19 & 20 and parts of Lot 13 of the Plat of John Greenleaf as M C Sub. of 43 Ac. W. Pt. Eaton Farms, as shown in Plat Book 1 Page 118, Recorder's Office, Franklin County, Ohio, and also being all of a 47.2 acre tract conveyed to Franklin County Commissioners County Stadium, as conveyed to the Franklin County Commissioners by Deed Book 3499 Page 445, Deed Book 3563 Page 298, Deed Book 3565 Page 434, and Official Record 27144 J10, and being more particularly described as follows:
Beginning at the intersection of the existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 25131 (Recorded Reference Unknown), being the northeasterly corner of a 14.507 acre tract as conveyed to TTG Properties LLC. By deed of record Instrument Number 199802040024868, Recorder's Office, Franklin County, Ohio, being in the southerly right-of-way of Mound Street (66'wide), and being also the northwesterly corner of said 47.2 acre tract;
Thence easterly approximately 1148 feet along the northerly line of said 47.2 acre tract, and said southerly right-of-way of Mound Street (66' wide), and said existing corporation line, to the northeasterly corner of said 47.2 acre tract, and being also the northwesterly corner of said Eaton Farms Subdivision and the northwesterly corner of a 26.850 acre tract as conveyed to Bishop Edward J. Herrmann by deed of record in Deed Book 3377 Page 404 (Last described in Deed Book 95 Page 589, Recorder's Office, Franklin County, Ohio);
Thence southerly approximately 945 feet along a easterly line of said 47.2 acre tract, along the easterly line of said Eaton Farms Subdivision, and also along the westerly line of said 26.850 acre tract, to the southwesterly corner of Lot 18 of said Eaton Farms, the northwesterly corner of Lot 19 of said Eaton Farms, and also a southeasterly corner of said 47.2 acre tract, and said being also the southwesterly corner of said 26.850 acre tract;
Thence easterly approximately 662 feet along a southerly line of said 47.2 acre tract, the northerly line of said Lot 19, the southerly line of said Lot 18, also along the southerly line of said 26.850 acre tract, to the northwesterly corner of a 1.000 acre tract as conveyed to Temple Israel by deed or record Deed Book 1028 Page 589, Recorder's Office, Franklin County, Ohio, and being also a southeasterly corner of the said 47.2 acre tract;
Thence southerly approximately 83 feet along a easterly line of said 47.2 acre tract, and also along the westerly line of said 1.000 acre tract, to the southwesterly corner of said 1.000 acre tract, and being also a southeasterly corner of the said 47.2 acre tract;
Thence easterly approximately 528 feet along a southerly line of the said 47.2 acre tract, also along the southerly line of said 1.000 acre tract, and also through Lot 13 of said Eaton Farms Subdivision, to the intersection of an existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 25131 (Recorded Reference Unknown), being the southeasterly corner of said 1.000 acre tract, and being the easterly line of said Lot 13, and also being also in the westerly right-of-way of Mt. Calvary Avenue (66' wide), and being also a southeasterly corner of said 47.2 acre tract,
Thence southerly approximately 557 feet along said City of Columbus Corporation Line, as established by Columbus Ordinance No. 25131, along said westerly right-of-way of Mt. Calvary Avenue (66' wide), along the easterly lines of Lots 13, 14, 15, and 16 of said Eaton Farms Subdivision, and also along the easterly line of the said 47.2 acre tract to the intersection of said City of Columbus Corporation Line, as established by Columbus Ordinance No. 25131, and the existing City of Columbus Corporation Line as established by Columbus Ordinance No. 669-60, Miscellaneous Record MR 123 Pg. 505, Recorder's Office, Franklin County Ohio, being the southeasterly corner of said 47.2 acre tract, being the southeasterly corner of said Lot 16, and being also the northeasterly corner of a 3.369 acre tract as conveyed to Columbus Metropolitan Housing Authority by deed of record Official Record 01308A03, Recorder's Office, Franklin County, Ohio;
Thence westerly approximately 1107 feet along said existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 669-60, along the northerly line of said 3.369 acre tract, and the southerly line of said 47.2 acre tract, along the southerly line of Lot 16 and 20 of said Eaton Farms Subdivision, and also along the northerly line of a 10.612 acre tract as conveyed to Green Lawn Cemetery Association by deed of record Deed Book 1684 Page 533, Recorder's Office, Franklin County, Ohio, to the southwest corner of Lot 20 of said Eaton Farms Subdivision;
Thence westerly approximately 1218 feet along the northerly line of said 10.612 acre tract, continuing along the southerly line of said 47.2 acre tract, also along the northerly line of a 319.245 acre tract as conveyed to Green Lawn Cemetery Association by deed of record Deed Book 39 Page 330, and Deed Book 569 Page 489, Recorder's Office, Franklin County, Ohio, to the intersection of an existing City of Columbus Corporation Line, as established by Columbus Ordinance No. 974-92, Official Record 19906 G-18, Recorder's Office, Franklin County Ohio, to the southwesterly corner of said 47.2 acre tract, and being also the southeasterly corner of a 6.352 acre tract as conveyed to Allwaste Tank Cleaning Inc. by deed of record Official Record 17677H06, Recorder's Office, Franklin County, Ohio;
Thence northerly approximately 1150 feet along part of said City of Columbus Corporation Line, as established by Columbus Ordinance No. 974-92, and along the easterly line of said 6.352 acre tract, along the easterly line of said 14.507 acre tract, and also along the westerly line of said 47.2 acre tract, to the place of beginning, containing 47.2 acres, more or less;
Section 2. That the City of Columbus will accept the territory described in section 1 upon approval of the petition by the Board of Franklin County Commissioners and take any necessary steps to record such acceptance.
Section 3. That the City Clerk is hereby authorized and directed to make a copy of this ordinance for submission to the Board of Franklin County Commissioners in conjunction with the annexation petition.
Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
