Explanation
BACKGROUND: This ordinance authorizes the Finance and Management Director to enter into a contract with Kone, Inc. for maintenance and service of elevators in various city facilities under the purview of the Facilities Management Division. Kone, Inc. has been the current elevator maintenance and service provider for the last five years. This contract expires at the end of July 2008 and was therefore re-bid. This contract will have five renewal options. Kone, Inc. was again the lowest and best bidder.
Formal bids (SA002929) were received from three companies on June 17, 2008 as follows (0 MBE, 0 FBE)

The Facilities Management Division recommends the contract be awarded to the most responsive, responsible and best bidder, Kone, Inc. John Blatt Elevator Consultants helped the Division review the bids and also determined Kone, Inc. to be the most responsive and responsible bidder.
Emergency action is requested so that required maintenance and service on elevators is not delayed, ensuring no disruption in service, thereby protecting the safety of elevator users.
Fiscal Impact: The cost of the contract is $125,952.00, plus $15,048.00 fixed contingency for a grand total of $141,000.00. The cost of the elevator contract in 2007 was $185,436.00. In 2006, the cost of the contract was $169,104.00. The amount budgeted for 2008 was $175,000.00.

WHEREAS, it is necessary to enter into contract with Kone, Inc. for maintenance and service of elevators, and
WHEREAS, said contract will provide service and maintenance in various city buildings under the purview of the Facilities Management Division, and
WHEREAS, Kone, Inc. is the most responsive, responsible, and best bidder, and
WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Facilities Management Division, in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Kone, Inc. for the maintenance and service of elevators, thereby preserving the public health, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to enter into a contract with Kone, Inc. for maintenance and service of elevators for the Facilities Management Division for the period of August 1, 2008 to July 31, 2009.
SECTION 2. That the expenditure of $141,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, be and is hereby authorized and approved as follows:

SECTION 3. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
