Explanation

 

BACKGROUND:  This legislation authorizes the Director of the Department of Finance and Management to enter into a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for City facilities under the purview of the Facilities Management Division.

 

The initial term of this contract was from April 1, 2024- March 31, 2025. Due to funding limitations, the department was not able to renew this contract prior to the expiration date.  With the completion of the third (3rd ) transfer, we enter this contract requesting four (4) annual renewal options, which may be exercised at the discretion of the City. The contract will not automatically renew and is subject to funds availability and approval of Columbus City Council. Ohio Technical Services will adhere to Code Section 329.18(c) (8) regarding payment of a responsible wage.

Bids were solicited via RFQ026935 and the City received one bid on March 13, 2024.  Ohio Technical Service was the sole responder to the bid. 

 

Given the timing and the criticality of this service, a waiver of the bidding requirements of Columbus City Code Chapter 329 is requested.

 

Emergency action is requested to ensure that hazardous materials contract may be immediately available for services as soon as practical.  The previous contract expired in March 2025.  As such, no contract exists that provides this critical service.

 

Ohio Technical Services, Inc. Contract Compliance No. 31-1640431 contract compliance expiration date January 21, 2027.

 

Fiscal Impact: This ordinance authorizes the expenditure of $130,000.00 from the General Fund with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials. 

 

Title

 

To authorize the Director of the Department of Finance and Management to enter into a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials from city facilities; to authorize the expenditure of $130,000.00 from the General Fund; to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes; and to declare an emergency. ($130,000.00) 

 

Body

 

WHEREAS, it is necessary for the Facilities Management Division to contract for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division; and

 

WHEREAS, formal bids were solicited and one vendor submitted a response; and

 

WHEREAS, Ohio Technical Services, Inc. was deemed the most responsive, and responsible bidder; and

 

WHEREAS, a waiver of the bidding requirements of Columbus City Code Section 329 is requested for this contract; and

 

WHEREAS, an emergency exists in the usual daily operation of the Finance and Management Department, Facilities Management Division, in that it is immediately necessary to authorize the Finance and Management Director to enter into a contract with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division, to ensure that hazardous materials can be tested for and remediated at various City facilities. The previous contract expired in March 2025 and, as such, no contract currently exists to provide this critical service, all for the immediate preservation of the public health, peace, property, and safety; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of the Department of Finance and Management is hereby authorized to enter into a contract on behalf of the Facilities Management Division with Ohio Technical Services, Inc. for inspection, testing, removal, and/or remediation of hazardous materials for facilities under the purview of the Facilities Management Division.

 

SECTION 2.  That the expenditure of $130,000.00, or so much thereof that may be necessary in regard to the action authorized in SECTION 1, is hereby authorized in the General Fund 1000, in Object Class 03 - Contractual Services, per the accounting codes in the attachment to this ordinance.

 

SECTION 3. That this ordinance is submitted in accordance with the bid waiver provisions of Section 329 of Columbus City Codes and City Council does hereby waive the competitive bidding requirements under the Columbus City Codes.

 

SECTION 4. That the monies in the foregoing sections shall be paid upon order of the Director of Finance and Management, and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.

 

SECTION 5.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 7.  That City Council finds it in the best interest of the City to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes, and does hereby waive the same.

 

SECTION 8.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
