Background: This legislation authorizes the Director of Finance and Management to execute those documents necessary to enter into a Second Amendment to Lease Agreement to extend the lease with Beaumont 4522, LLC to add three one (1) year automatic renewal terms options to the Lease Agreement for office and clinic space located at 4550 Indianola Avenue, Columbus, Ohio, occupied by Columbus Public Health’s Women, Infants and Children (WIC) Program and repeals Ordinance #2096-2019, passed July 29, 2019.
WIC is a supplemental nutrition program for women (pregnant, postpartum and breastfeeding), infants, and children under five years of age. The extension of the Lease Agreement for 4550 Indianola Avenue is necessary due to the inability to come to a final agreement for the lease of alternative clinic and office space as authorized by Ordinance #2096-2019. The WIC program wishes to continue to occupy its current leased space for up to an additional three years in order to allow additional time to evaluate service delivery in this geographic area. The Real Estate Management Office has negotiated an extension of the lease with the landlord to allow for three additional one (1) year renewal terms. The first extended one-year automatic renewal term for the existing WIC Clinic at 4550 Indianola Avenue will commence on October 1, 2019.
Fiscal Impact: Funding for the payment of rent for the first extended one-year automatic renewal term is authorized by Ordinance 2397-2019.
Emergency Action: This legislation is presented as an emergency in order for the WIC Clinic located at the 4550 Indianola Avenue to continue providing program services to the community without interruption.

To authorize the Director of Finance and Management to execute those documents necessary to execute a Second Amendment To Lease Agreement to amend and extend the current lease agreement with Beaumont 4522, LLC for Columbus Public Health; to repeal ordinance 2096-2019; and to declare an emergency.
Body
WHEREAS, the Department of Finance and Management, through its Real Estate Management Office, leases clinical office space located at 4550 Indianola Avenue on behalf of the Department of Health’s Women, Infants and Children (WIC) Program, and
WHEREAS, the current term of the Lease Agreement for the WIC Clinic located at 4550 Indianola Avenue expires September 30, 2019, and
WHEREAS, it is necessary to amend and extend the existing lease for clinical office space at 4550 Indianola Avenue to allow WIC additional time to evaluate service delivery in this geographic area;
WHEREAS, it is necessary to enter into a Second Amendment to Lease Agreement to add three automatic one (1) year renewal terms options to the existing Lease Agreement with Beaumont 4522, LLC; and
WHEREAS, the first extended one-year automatic renewal term will commence on October 1, 2019 and expire September 30, 2020, and;
WHEREAS, Ordinance #2096-2019, passed July 29, 2019, shall be repealed; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to authorize the additional renewal term to the lease in order to allow the WIC clinic to continue offering program services to the community without interruption for the immediate preservation of the health, peace, property, safety and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management be, and hereby is, authorized to execute a Second Amendment To Lease Agreement by and between the City of Columbus and Beaumont 4522, LLC as prepared and approved by the Department of Law, Division of Real Estate, to provide for three additional one (1) year automatic renewal terms subject to the annual authorization of rental funds by City Council and certification of funds availability by the City Auditor and amend other related terms and necessary.
SECTION 2. That Ordinance #2096-2019, passed by this Council on July 29, 2019, be and is hereby repealed.
SECTION 3. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
