Explanation

 

Section 2.4 of the Collective Bargaining Agreement between the City of Columbus and Fraternal Order of Police, Capital City Lodge #9, dated December 9, 2023 through December 8, 2026, requires that any modifications to the Agreement be agreed to by the parties in writing. Memorandum of Understanding (MOU)  #2025-02 amends Article 21 of the Agreement by crediting the prior law enforcement service, as defined in the MOU, of lateral entry police officers and officers reemployed pursuant to Article 21.3 (D) when placing these officers in the pay plan and designating how the officers advance through the pay plan. 

 

The passage of this ordinance indicates City Council’s approval of MOU #2025-02, a copy of which is attached hereto.

 

Emergency action is recommended in order to allow for expedient implementation in order to immediately credit the prior law enforcement service, as defined in the MOU, when placing lateral entry police officers and officers reemployed, pursuant to Article 21.3 (D), in the pay plan and designating how the officers advance through the pay plan.

Body

 

WHEREAS, representatives of the City of Columbus and the Fraternal Order of Police, Capital City Lodge #9 entered into Memorandum of Understanding #2025-02, a copy of which is attached hereto, which amends Article 21 of the Agreement between the City and the Fraternal Order of Police, Capital City Lodge #9, December 9, 2023 through December 8, 2026, by accounting for prior law enforcement service, as defined in the MOU, of lateral entry police officers and officers reemployed pursuant to Article 21.3 (D) when placing the aforementioned officers in the pay plan and designating how the officers advance through the pay plan; and

 

WHEREAS, emergency action is recommended in order to implement the terms of the MOU in a timely manner; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Human Resources and Public Safety in that it is immediately necessary to amend the Collective Bargaining Agreement between the City and Fraternal Order of Police, Capital City Lodge #9, by approving Memorandum of Understanding #2025-02 in order to allow for expedient implementation so as to immediately credit the prior law enforcement service of lateral entry police officers and officers reemployed, pursuant to Article 21.3 (D), place the aforementioned officers in the pay plan in accordance with the MOU and designate how the officers advance through the pay plan; for the immediate preservation of the public peace, property, health, safety, and welfare; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Memorandum of Understanding #2025-02 amends Article 21 of the Collective Bargaining Agreement between the City and the Fraternal Order of Police, Capital City Lodge #9, December 9, 2023 through December 8, 2026.

 

SECTION 2.  That City Council, in the best interests of the City, hereby, recognizes and approves MOU #2025-02, a copy of which is attached hereto, executed between representatives of the City and the Fraternal Order of Police, Capital City Lodge #9.

 

SECTION 3.   That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure, and shall take effect and be in force from and after its passage and approval by the Mayor, or ten (10) days after passage if the Mayor neither approves nor vetoes the same.
