Explanation

 

Background: The Wheatland Avenue Property is situated in the Hilltop on the north side of West Broad Street just east of Wheatland Avenue and west of The Ohio Department of Transportation.  Dominion Homes is interested in purchasing these 22 acres from the City to construct single-family homes.  A Phase 1 Environmental Assessment showed numerous foundations remaining underground from the previous structures that made up the Psychiatric Hospital complex.  A Phase II investigation is necessary to comply with the requirements of the Ohio Voluntary Action Program and will provide the necessary information to support a Clean Ohio Fund grant application to obtain the necessary cleanup funding.  The Director of Development wishes to enter into a $50,000 contract with Civil & Environmental Consultants, Inc. and Calderon-Grant, Inc. to conduct the Phase 2 investigation.

 

Fiscal Impact: $50,000 in capital funds to be expended from Development's Fund 742.

 

Emergency Justification: Emergency action is requested in order to utilize the results of the Phase 2 investigation in an application for a Clean Ohio Fund grant due in May 2005.

 

 

 

 

Title

 

To authorize the Director of Development to enter into a contract with Civil & Environmental Consultants, Inc. and Calderon-Grant, Inc. for the purpose of conducting a Phase 2 environmental assessment of the Wheatland Avenue property; to authorize the expenditure of $50,000 from the Development Limited Bond Fund; to waive the formal professional service contracts process of Chapter 329 of the City Code; and to declare an emergency. Body

 

WHEREAS, the City of Columbus owns 22 acres on North Wheatland Avenue which will be developed with single family homes; and

 

WHEREAS, Dominion Homes has offered to purchase the property for the above purpose; and

 

WHEREAS, it is necessary for the Director of Development to enter into a $50,000 contract with Civil & Environmental Consultants, Inc. and Calderon-Grant, Inc. to conduct a Phase II environmental assessment of the property; and

 

WHEREAS, the assessment will provide the necessary information to support a Clean Ohio Fund grant application to obtain the necessary cleanup funding in order to provide a safe environment for residential development; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to authorize its Director to contract for the purpose of conducting a Phase 2 environmental assessment of the Wheatland Avenue property, all for the preservation of the public health, peace, property and safety; Now therefore,

 

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

Section 1.                     That the Director of Development be and is hereby authorized to enter into a contract for Fifty Thousand Dollars ($50,000) with Civil & Environmental Consultants, Inc. and Calderon-Grant, Inc. for the purpose of conducting a Phase 2 environmental assessment of the Wheatland Avenue property.

 

Section 2.                     That for the purpose stated in Section 1, the expenditure of up to $50,000 from the Development Department, Division No. 44-01, Fund No. 742, Project No. 440104 Miscellaneous Economic Development, OCA Code 643106, Object Level Three 6680 is hereby authorized.

 

Section 3.                     That the formal consultant selection process provisions of Chapter 329 of the City Code be and are hereby waived.

 

Section 4.                     That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
