Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to execute a contract with Kokosing Construction Company, Inc., for the construction of the Rustic Bridge Area Sanitary Improvements Project. This project will rehabilitate approximately 10,320 lineal feet of 8 and 15-inch diameter sewer that is in excess of 70 years old. The project will utilize trenchless technology that greatly minimizes the impacts upon the neighborhood for which this infrastructure provides service. The area of Clintonville affected by this project is generally bounded between the first alley east of N. High Street, north of Beechwold Blvd., west of Foster Ave., and south of Morse Road; and also includes an area along Fuller Drive, just north of Morse Rd.
The Director of Public Utilities publicly opened four competitive bid proposals on October 13, 2004. The results of these bids were: Kokosing Construction Company, Inc. submitted a bid of $633,677.60; Reynolds Inliner submitted a bid of $680,872.22; American Water Services submitted a bid of $793,004.35; and Insituform Technologies submitted a bid of $805,690.00. The Engineer's Estimate for this project was $956,708.00.
2. EMERGENCY LEGISLATION:
The Division of Sewerage and Drainage is requesting City Council to consider this legislation an emergency measure in order to allow for the immediate commencement of this contract work that is necessary to rehabilitate nearly 2 miles of sanitary sewer serving a residential area in the Clintonville community, pursuant to ensuring the continued operation of this vital sanitary sewer infrastructure.

WHEREAS, four competitive bids for the construction of the Rustic Bridge Area Sanitary Improvements Project; were received on October 13, 2004, and
WHEREAS, the Ohio Water Development Authority approved a loan to the City of Columbus on March 31, 2005, in the amount of $743,105.00, identified as OWDA Loan No. CS392400-01; and
WHEREAS, it is immediately necessary for the City Council to both appropriate the proceeds from the aforementioned loan agreement and to authorize the expenditure of funds from the Ohio Water Pollution Control Loan Fund; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, in that it is necessary for this City Council to authorize the Director of Public Utilities to execute a contract for the construction of the Rustic Bridge Area Sanitary Improvements Project; to appropriate and authorize the expenditure of the proceeds from the aforementioned loan; and to amend the 2004 Capital Improvements Budget; all of which is necessary to allow for the immediate rehabilitation of this aging and structurally deficient sanitary sewer infrastructure, for the preservation of the public health, peace, property, and safety; Now, Therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the proceeds from the Ohio Water Development Authority Loan No. CS392400-01, for the Rustic Bridge Area Sanitary Improvements Project; and funds from the unappropriated monies in Fund 666, the amount of $633,677.60 for the cost of construction and construction administration services, is hereby appropriated to the Division of Sewerage and Drainage, Division 60-05, Fund No. 666; Object Level Three 6630; OCA Code 666667; Project Account 650667.
Section 2 That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the CS392400-01 with the lowest, and best bidder, Kokosing Construction Company, Inc., PO Box 711991, Columbus, Ohio 43271-1791, in the amount of $633,677.60, in accordance with the terms and conditions of the Contract on file in the Sewer System Engineering Section Offices of the Division of Sewerage and Drainage.
Section 3. That for the purpose of paying the cost of construction contract, the expenditure of $633,677.60, or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Project 650667| OCA Code 666667| Object Level 3 No. 6630.
Section 4. That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the execution of the subject construction contract agreement:

Section 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
