Explanation
The purpose of this legislation is to authorize the Director of Public Utilities to enter into a service agreement with Cornerstone OnDemand, Inc., for the Cornerstone OnDemand Learning Management Software System, CyberU Enterprise's annual renewal for the Department of Public Utilities. The Cornerstone OnDemand software is used by the Department of Public Utilities to manage mandatory training for its employees.
The city's Learning Management Software System is a proprietary system from Cornerstone OnDemand, Inc., and as such, the city must purchase annual support and maintenance services from Cornerstone OnDemand, Inc. Therefore, this ordinance is being submitted in accordance with the provisions of sole source procurement of the City of Columbus Codes, Chapter 329.
The annual renewal for the Cornerstone OnDemand Learning Management Software System, CyberU Enterprise module is in effect for a period of one (1) year to and including November 7, 2023 with the option to renew three (3) times for one (1) year terms. This agreement is subject to the authorization of Columbus City Council and the certification by the City Auditor of the availability of funds for such purposes. This service agreement will not automatically renew.

To authorize the Director of the Department of Public Utilities to enter into a service agreement in accordance with sole source provisions of the Columbus City Codes with Cornerstone OnDemand, Inc., for software support of the Cornerstone OnDemand Learning Management Software System, CyberU Enterprise; and to authorize the expenditure of $1,733.07 from the Electricity Operating Fund, $11,023.43 from the Water Operating Fund, $12,358.74 from the Sewerage System Operating Fund, and $3,295.66 from the Stormwater Operating Fund. ($28,410.90)
Body
WHEREAS, the Department of Public Utilities utilizes the Cornerstone OnDemand, Inc. for the Cornerstone OnDemand Learning Management Software System, CyberU Enterprise and is the sole developer of this software; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Utilities to authorize the Director to enter into a service agreement in accordance with the relevant provisions of Chapter 329 of City Code relating to Sole Source procurement; and
WHEREAS, the Department of Public Utilities wishes to enter into a service agreement for a period of one (1) year to and including November 7, 2023 with an option to renew for three (3) additional one (1) year terms with the funding based upon budgeted funds and approved by Columbus City Council; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Public Utilities is authorized to enter into a service agreement with Cornerstone OnDemand, Inc., 1601 Cloverfield Blvd., Suite 620 South, Santa Monica, CA 90404 for the Cornerstone OnDemand Learning Management Software System, CyberU Enterprise for a period of one (1) year, in accordance with the pertinent provisions for Sole Source procurement of Chapter 329 of the Columbus City Code.
SECTION 2. That the expenditure of $28,410.90, or so much thereof as may be needed, is hereby authorized in Fund 6100 Sanitary Sewer Operating Fund, Fund 6000 Water Operating Fund, Fund 6300 Power Operating Fund, and Fund 6200 Stormwater Operating Fund, in the amount of $28,410.90 per the accounting codes in the attachment to this ordinance.
SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
