Explanation
 
Background:  The following legislation amends the Columbus City Codes, 1959, by enacting a new section of Columbus City Code, Section 2105.25, which authorizes the Public Service Director to designate areas of the city as "NO ENGINE BRAKING" zones.  Some trucks, especially semi-tractor trailers, are equipped with a special braking system that uses engine compression to slow the vehicle.  These braking systems, called "Jake Brakes," make loud popping noises that create excessive noise and are often objectionable to the general public.  The use of these braking systems within areas that are primarily residential in nature adversely affects the quality of life within these areas.  The proposed new code section will allow the Public Service Director, upon determining that the frequent use of these braking systems within specific residential areas is detrimental to the area, to establish "NO ENGINE BRAKING" zones.  Upon passage of this legislation the first area to be designated a 'NO ENGINE BRAKING" zone will be at the exit ramps to Neil Avenue from I-670.  The Ohio Department of Transportation will install the appropriate signing on these I-670 ramps upon establishment of these zones.

WHEREAS, some trucks, especially semi-tractor trailers, are equipped with a special braking system that uses engine compression to slow the vehicle; and
 
WHEREAS, these braking systems, called "Jake Brakes," make loud popping noises that create excessive noise and are often objectionable to the general public; and
 
WHEREAS, the use of these braking systems within areas that are primarily residential in nature adversely affects the quality of life within these areas; and
 
WHEREAS, there is a need to regulate the areas where these engine braking systems may be used for the protection of the general public, now, therefore;
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That Columbus City Code shall be amended with the addition of Section 2105.25, entitled No Engine Braking Zones as follows:
 
2105.25      No Engine Braking Zones
The service director shall establish No Engine Braking zones of such kind and character and at such locations as he may deem necessary for the protection of the public.
 
SECTION 2.       That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
