Council Variance Application: CV22-104

PROPOSED USE: Multi-unit residential development.

 

COLUMBUS SOUT HSIDE AREA COMMISSION RECOMMENDATION: Approval.

                                                                                 

CITY DEPARTMENTS' RECOMMENDATION: Approval. The 27.96± acre site consists of nine parcels developed with a variety of industrial uses in the M, Manufacturing District. The requested Council variance will allow multi-unit residential development, with no density limitation, in the M district. A variance to increase allowable building height from 35 feet to 60 feet is included in the request. The site is within the planning boundaries of the South Side Plan (2014), which recommends “Industrial” land uses at this location. The Plan also includes early adoption of the Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). While the proposed multi-unit residential development is inconsistent with the area plan, staff supports the proposed use because the site is located on a major transit corridor and is adjacent to Title 34 mixed-use zoning districts. Staff also supports the use of a Council variance to achieve the proposed development as the applicant will be seeking competitive funding from the Ohio Housing Finance Authority (OHFA), and because the site is included in the focus area of the next phase of Zone In which will likely result in a new zoning district being applied to this property. Additionally, the request is consistent with the city’s objective to provide more housing in all neighborhoods.

To grant a Variance from the provisions of Sections 3363.01, M-manufacturing districts; and 3309.14, Height districts, of the Columbus City codes; for the property located at 2025 S. HIGH ST. (43207), to allow multi-unit residential development with increased building height in the M, Manufacturing District (Council Variance #CV22-104).

 

Body

 

WHEREAS, by application #CV22-104, the owner of property at 2025 S. HIGH ST. (43207), is requesting a Variance to allow multi-unit residential development with increased building height in the M, Manufacturing District; and

 

WHEREAS, Section 3363.01, M, Manufacturing District, prohibits most residential uses, while the applicant proposes a multi-unit residential development with unlimited density on the subject property; and

 

WHEREAS, Section 3309.14(A), Height districts, prohibits the height of a building to exceed 35 feet at the building setback line, while the applicant proposes increased building heights of sixty feet for the proposed multi-unit residential development; and

 

WHEREAS, the Columbus South Side Area Commission recommends approval; and

 

WHEREAS, City Departments recommend approval because the requested variances would allow multi-unit residential development providing more housing, on a major transit corridor, adjacent to Title 34 mixed-use districts; and 

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed development; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and

  

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 2025 S. HIGH ST. (43207), in using said property as desired and; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That a variance be granted from the provisions of Sections 3363.01, M-manufacturing districts; and 3309.14, Height districts, of the Columbus City codes; for the property located at 2025 S. HIGH ST. (43207), insofar as said sections prohibit multi-unit residential development with an increased building height of sixty feet; said property being more particularly described as follows:

 

2025 S. HIGH ST. (43207), being 27.96± acres located at the intersection of South High Street and Viaduct Drive, and being more particularly described as follows:

 

Situated in the City of Columbus, County of Franklin, State of Ohio, being all of that property conveyed to CONSOLIDATED ELECTRICAL by Deed 27964 B03 (Parcel #010-113129), STEELTON HOLDINGS II LLC by Instrument #202001020000674 (Parcel 010-112126 & 010-

055272), BROADLEIGH PROPERTIES LLC by Instrument #201809100121942 (Parcel #010-112349, 010-013541, 010-037423, 010-028706 and 010-025710), and STEELTON HOLDINGS II LLC by Instrument #202001020000673 (Parcel #010-112264 & 010-008499), being more

fully described as follows:

 

Commencing at the southeast corner of said CONSOLIDATED ELECTRICAL (Parcel #010-113129), said corner also being the TRUE PLACE OF BEGINNING of the parcel herein described.

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for multi-unit residential development, or those uses permitted in the M, Manufacturing District.

 

SECTION 3.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed development.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
