Explanation
This legislation authorizes the Director of the Recreation and Parks to sign a Maintenance Agreement with the Ohio Department of Transportation for the improvements made as part of the Olentangy Trail --Antrim Park to Bethel Road Connector project. ODOT PID # 99743
Background: Recreation and Parks is constructing improvements to the Olentangy Trail between Antrim Park and Bethel Road. The project includes trail improvements within the Bethel Road section across SR 315. The maintenance agreement specifies that CRPD will be responsible for maintaining and inspecting the culvert, lighting, and safety items within the limited access right-of-way controlled by ODOT.

Emergency Justification: An emergency is being requested to enter into said contract as the construction of the project is underway, and ODOT wishes to have the agreement in place.
Benefits to the Public: Safe access for thousands of residents along the Bethel Road/Olentangy River Road corridor by: widening the trail from 9’ to 12’ to increase capacity; installing guardrail separation along sections where 315 and trail are too close for trail users and motorist safety; constructing a fully compliant connector ramp from the trail to Bethel Road; constructing a shared use path along Bethel Road to Olentangy River Road/Anheuser Busch Park, creating a new, easy access trail head.

Master Plan Relation: This project will support the mission of the Recreation and Parks Master Plan by improving access to trails and greenways corridors. Improving the environmental health of the city’s waterways; improving recreational access to streams; providing long term protection corridors for water quality and trail development.
Fiscal Impact: No fiscal action is requested at this time. The improvements noted herein will result in a minimal impact to operating costs as the upgrades will not result in significant changes to the duties already being performed in this area.

WHEREAS, is necessary to authorize the Director Recreation and Parks to sign a Maintenance Agreement with the Ohio Department of Transportation for the improvements made as part of the Olentangy Trail --Antrim Park to Bethel Road Connector project; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to Maintenance Agreement with the Ohio Department of Transportation as the construction of the project is underway, and ODOT wishes to have the agreement in place, thereby preserving the public health, peace, property, safety, and welfare; NOW, THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Recreation and Parks Department be and is hereby authorized to sign a Maintenance Agreement with the Ohio Department of Transportation for the improvements made as part of the Olentangy Trail --Antrim Park to Bethel Road Connector project.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
