Explanation
 
BACKGROUND:  This legislation authorizes the appropriation and expenditure of $16,035.00 from the Emergency Human Services Capital Fund. Funds will be used by the Department of Development for a grant agreement to The Community Arts Project dba The King Arts Complex for the purpose of installing a complete HVAC system within the connecting corridor between the Garfield building and the Pythian building located at 867 Mt. Vernon Avenue.  
 
The Martin Luther King Jr. Performing and Cultural Arts Complex exists to enrich and improve the quality of life in the community by preserving, presenting, promoting and fostering the contributions of African Americans through creative expression and education. The Martin Luther King Jr. Performing and Cultural Arts Complex opened in 1987 and is the only multi-disciplinary non-profit arts facility in Ohio providing year round educational, performing arts and cultural arts programs celebrating the contributions of African Americans.  During the process of installing a permanent interactive learning area called The Middle Passage it was discovered that only the façade of an HVAC system existed and that the vents and heating panels associated with the system were never connected thus resulting in water draining into the area and creating wet, slippery floors and irregular temperatures during winter and summer months.  The installation of a complete HVAC system will eliminate these problems.  
 
This legislation is presented as an emergency in order to assist the organization in timely manner.    
                 
FISCAL IMPACT:  Funds are allocated from the FY2006 Emergency Human Services Capital Fund.   
 
 
 
Title

Body
 
WHEREAS, it is the desire of the Director of the Department of Development to appropriate funds from the unappropriated balance of the Emergency Human Services Capital Program Fund and to enter into a grant agreement with The Community Arts Project dba The King Arts Complex; and
 
WHEREAS, the grant will fund the installation of an HVAC system for the Middle Passage section of The Martin Luther King Jr. Performing & Cultural Arts Complex located a 867 Mt. Vernon Avenue; and
 
WHEREAS, grant funds will also be used to install roof flashing for the HVAC unit and the removal of ceiling heat units in the facility's breezeway; and
 
WHEREAS, the new HVAC system to be installed will eliminate the draining of water and the creation of slippery floors and irregular temperatures during winter and summer months in the Middle Passage section of The King Arts Complex; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to enter into a grant agreement with The Community Arts Project dba The King Arts Complex, all for the preservation of the public health, peace, property, safety, and welfare; NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.        That from the unappropriated monies in the Emergency Human Services Capital Fund, and from any and all sources unappropriated for any other purpose during the fiscal year ending December 31, 2006, the sum of $16,035.00 be and is hereby appropriated to the Department of Development, Department No. 44-05, Fund 232, Object Level One 03, Object Level Three 3337, OCA Code 440508, Project 200001.
 
Section 2.        That the Director of the Department of Development be and is hereby authorized to enter into a grant agreement with The Community Arts Project dba The King Arts Complex for the installation of an HVAC system located at 867 Mt. Vernon Avenue.
 
Section 3.         That for the purpose as stated in Section 2, the expenditure of $16,035.00 or so much thereof as may be necessary, be and is hereby authorized to be expended from the Emergency Human Services Capital Fund, Department of Development, Department No. 44-05, Fund 232, Object Level One 03, Object Level Three 3337, OCA Code 440508, Project 200001.
 
Section 4.              That for the reasons stated in the preamble hereto, which is made a part hereof, this ordinance is declared to be an emergency measure and shall take effect and shall be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
