APPLICANT:  Troon Management Ltd; c/o W. Vincent Rakestraw; 4930 Reed Road, Suite 200;  Columbus, OH 43220.
 
PROPOSED USE:  Manufacturing, commercial and/or office development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on March 13, 2008.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested M, Manufacturing District will allow manufacturing and/or commercial development.  This is one of the few remaining residentially zoned properties in an area which is predominantly zoned for manufacturing.  Staff finds the current residential zoning to be unsuited to the area and supports this rezoning to the M, Manufacturing District because it will make the zoning and land uses consistent with the existing surrounding manufacturing zoning and land uses in accordance with the West Columbus Interim Development Concept (1991).

WHEREAS, application #Z07-059 is on file with the Building Services Division of the Department of Development requesting rezoning of 3.8± acres from R, Rural District, to the M, Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested M, Manufacturing District will allow manufacturing and/or commercial development.  This is one of the few remaining residentially zoned properties in an area which is predominantly zoned for manufacturing.  Staff finds the current residential zoning to be unsuited to the area and supports this rezoning to the M, Manufacturing District because it will make the zoning and land uses consistent with the existing surrounding manufacturing zoning and land uses in accordance with the West Columbus Interim Development Concept (1991), now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
5132 FISHER ROAD (43228), being 3.8± acres located on the north side of Fisher Road, 100± feet east of Milepost Road (570-152099), and being more particularly described as follows:
 
LEGAL DECRIPTION
 
      Beginning at a point in the center of Fisher Free Pike, which bears North 78 deg. 04' West 200 feet from a spike at the southeast corner of survey 2986, and in the center of said Pike:
 
      Thence North 13 deg. 57' East 871.72 feet parallel with the East line of said survey 2986 to an iron pipe, passing an iron pipe on line at 20.03 feet in the north line of said Pike;
 
      Thence North 78 deg. 04' West 200 feet to an iron pipe;
 
      Thence South 13 deg. 57' West 871.72 feet parallel with the East line of said survey 2986 to a point in the center of the Fisher Free Pike, 20 feet measured at right angles from centerline thereof;
 
      Thence South 78 deg. 04' East with the center of said Pike 200 feet to the place of beginning, containing 4 acres of land.
 
EXCEPTING THEREFROM  .229 acres of land described as follows:
 
      Beginning at a point in the westerly property line in the proposed northerly R/W line to Feder- Fisher Road, said point bearing North 14 deg. O5' 52" East 50.03 feet from the southwest property corner; Thence following said northerly R/W line South 77 deg. 55' 08" East 69.19 feet; Thence South 77 deg. 18' 23" East 101.05 feet; Thence South 76 deg. 04' 53" East 30.90 feet to the Easterly property line; Thence South 14 deg. 05'52" West 49.78 feet to the southeasterly property corner; Thence North 14 deg. 05' 52" 50.03 feet to the point of beginning, the excepted parcel conveyed to the City of Columbus by deed of record, pursuant to the Feder-Fisher Road improvement and Construction project.
 
To Rezone From: R, Rural District,
 
To: M, Manufacturing District
 
Section 2.  That a Height District of thirty-five (35) feet is hereby established on the M, Manufacturing District on this property.
 
Section 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
