APPLICANT:    Dominion Homes, Inc.; c/o George R. McCue, Atty.; Crabbe, Brown and James, LLP; 500 South Front Street, Suite 1200; Columbus, Ohio 43215.
      
PROPOSED USE:  Single-family residential development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (3-2-1) on May 6, 2004.
 
NORTH EAST AREA COMMISSION RECOMMENDATION:  Disapproval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested PUD-6, Planned Unit Development District would permit 229 single-family dwellings at a net density of 5.35 units/acre with 15.26 acres of open space.  The proposed development is consistent with The Northeast Area Plan (1994) landuse recommendations for residential development not to exceed a density of 8-9 units/acre and the established zoning and development patterns of the area.

WHEREAS, application #Z03-108 is on file with the Building Services Division of the Department of Development requesting rezoning of 45.2± acres from R, Rural District, to the PUD-6, Planned Unit Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the North East Area Commission recommends disapproval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested PUD-6, Planned Unit Development District would permit 229 single-family dwellings at a net density of 5.35 units/acre with 15.26 acres of open space.  The proposed development is consistent with The Northeast Area Plan (1994) landuse recommendations for residential development not to exceed a density of 8-9 units/acre and the established zoning and development patterns of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situated in the State of Ohio, County Franklin, City of Columbus, being located in Quarter Township 3, Township 1, Range 17, United States Military Lands and being all of the 6.593 acre tract conveyed to John L. & Rebecca S. Jackson by deed of record in Official Record 10740 G11, all of the 11.542 acre tract conveyed to Ulrica Glover by deed of record in Instrument Number 199906290165211 and part of the 48.865 acre tract conveyed to Mount Herman Baptist Church by deed of record in Official Record 14231 G01, (all references refer to the records of the Recorder's Office, Franklin County, Ohio) and described as follows:
 
Beginning at a point in the centerline of Sunbury Road at a common corner of said 11.542 acre tract and the 0.688 acre tract conveyed to Gary Gordon & Diane Moore by deed of record in Official Record 12117 F14;Thence South 03° 51' 01" West, a distance of 682.25 feet, along said centerline of Sunbury Road and easterly lines of said 11.542 and 6.593 acre tracts, to a point at the southeasterly corner of said 6.593 acre tract;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the PUD-6, Planned Unit Development District on this property.
 
SECTION 3. That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved PUD-6, Planned Unit Development District and Application among the records of the Building Services Division as required by Section 3311.09 of the Columbus City Codes; said plans being titled, "VILLAGE AT STONECLIFF PUD DEVELOPMENT PLAN", "VILLAGE AT STONECLIFF CONCEPTUAL BUFFER PLAN", "VILLAGE AT STONECLIFF STANDARD INTERSECTION DETAILS" all signed by George R. McCue, Attorney for the Applicant, and dated May 26, 2004.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
