Explanation
BACKGROUND: For the option to purchase DNA Crime Lab Supplies for the Division of Police. The term of the proposed option contract would be through September 30, 2011 with the option to extend this contract for one (1) additional year.
The Purchasing Office negotiated with the sole provider, Applied BioSystems Group of Applera Corporation, in accordance with the Columbus City code Section 329.07(e). These items are the same as negotiated on SA001296 dated September 15, 2004 and are necessary to analyze DNA sample for the purpose of Human Identification. Pricing received is acceptable to the Division of Police.
The Purchasing Office is recommending award of a contract to Applied BioSystems Group of Applera Corporation. No reagents or parts other than those sold by this company, the patent owner for the PCR kits required for DNA testing, are authorized for use in the Police Crime Lab's equipment. The estimated annual expenditure for this contract is $150,000.00.

This ordinance is being submitted as an emergency because, without emergency action, no less than thirty-seven days will be added to this procurement cycle and the efficient delivery of valuable public services will be slowed.
FISCAL IMPACT: Funding to establish this option contract is budgeted in the Purchasing Contract Account. The Division of Police will be required to obtain approval to expend from their own appropriations for their estimated annual expenditures.

To authorize and direct the Finance & Management Director to enter into a sole source contract for the option to purchase DNA Crime Lab Supplies with Biosystems Group of Applera Corporation to authorize the appropriation and expenditure of one dollar to establish the contract from the Purchasing UTC Account, and to declare an emergency. WHEREAS, the Purchasing Office pursued a negotiated an agreement in accordance with the sole source provisions of the Columbus City Code; and
WHEREAS, this ordinance is being submitted as an emergency measure to ensure crime lab testing supplies are delivered when needed to the Division of Police; and
WHEREAS, an emergency exists in the usual daily operation of the Police Division in that it is immediately necessary to enter into a contract for an option to purchase DNA Crime Lab Supplies, thereby preserving the public health, safety, and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director be and is hereby authorized and directed to enter into a contract for an option to purchase DNA Crime Lab Supplies in accordance with their proposal through September 30, 2011 with the option to extend this contract for one (1) additional year as follows:
Applied Biosystems Group of Applera Corporation, all items as specified in the price list established in the amount of $1.00.
SECTION 2. That the appropriation and expenditure of $1.00 is hereby authorized from the Purchasing UTC Account, Organization Level 1: 45-01, Fund: 05-517, Object Level 3: 2270, OCA: 4511300, to pay the cost thereof.
SECTION 3. That this purchase is in accordance with the sole source provisions of Section 329.07 of the Columbus City Code.
SECTION 4. That for the reason stated in the preamble here to, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
