CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of one parcel developed with an automotive sales facility in the C-5, Commercial District. The requested C-4, Commercial District will allow regional-scale commercial uses, which are consistent with both the Columbus Growth Strategy (2026) land use recommendation of “Mixed Use 2,” and the existing development and zoning patterns along this section of North Wilson Road.

WHEREAS, application #Z26-019 is on file with the Department of Building and Zoning Services requesting rezoning of 1.05± acres from the C-5, Commercial District, to the C-4, Commercial District; and
WHEREAS, the Development Commission recommends approval of said zoning change; and
WHEREAS, the Greater Hilltop Area Commission recommends approval of said zoning change; and
WHEREAS, the City Departments recommend approval of said zoning change because the requested C-4, Commercial District is consistent with the Columbus Growth Strategy’s land use recommendation, and with the surrounding development and zoning patterns along this section of North Wilson Road; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
865 N. WILSON RD. (43204), being 1.05± acres located at the northwest corner of North Wilson Road and Ferrell Place, and being more particularly described as follows:
Situated in the State of Ohio, County of Franklin, City of Columbus and being more fully described as follows:
Being Lot No. 5 of Winner Homes, Wilson Road Subdivision, as the same is numbered and delineated upon the recorded plat thereof, of record in Plat Book 33, Page 10, Recorder’s Office, Franklin County, Ohio.
EXCEPTING THEREFROM (Lot No. 5) THE FOLLOWING:
Beginning at the northeasterly corner of said Lot 5 and the Grantor’s northeasterly property corner, said point being 39.83 feet left of Station 68+45.91 in the centerline of construction of Wilson Road as part of a survey made in 1967 by the Ohio Department of Highways Interstate Route 70, Section 7.60, in Franklin County, Ohio; thence with the easterly line of Lot 5 and the Grantor’s easterly property line South 23 deg. 59’49” East a distance of 104.86 feet to a point; thence continuing with the Grantor’s property line on a curve to the right, having a radius of 30.00 feet and a chord bearing South 0 deg. 05’52” West for 24.50 feet, a distance of 25.23 feet along the curve to a point; thence through the Grantor’s land North 30 deg. 00’19” West a distance of 145.95 feet to a point in the northerly line of said Lot 5 and the Grantor’s northerly property line; thence South 78 deg. 39’19” East a distance of 30.99 feet to the place of beginning, containing 2.265 square feet, more or less.

Situated in the State of Ohio, County of Franklin, City of Columbus, being a part of Virginia Military Survey No. 3316, Containing 0.1967 acre of land, more or less, out of Lot No. 2, as the same is numbered and delineated on the plat of Columbus West, of record in Plat Book 46, Page 65 (all references to plat books, deed books or instruments in this description refer to the records of the Recorder’s Office, Franklin County, Ohio), said 0.1967 acre tract of land being more particularly described as follows:
Beginning for reference, at the intersection of the centerlines of Wilson Road and Ferrell Place, thence N. 24 deg. 19’40” E, with the centerline of said Wilson Road, a distance of 136.63 feet to a point; thence N. 78 deg. 41’20” W, with the southerly line of that 13.416 acre tract of land as described in a deed to the State of Ohio, of record in Deed Book 2801, Page 240, with a portion of the northerly line of Winner Homes Wilson Road Subdivision, of record in Plat Book 33, Page 10, a distance of 79.98 feet to a 3/4” hollow iron pin (found) in the westerly limited access right-of-way line of Wilson Road, being the southeasterly corner of said Lot No. 2, the southwesterly corner of said 13.416 acre tract, said iron pin (found) also being the true point of beginning;
Thence, from said true point of beginning, N. 78 deg. 41’20” W, with the northerly line of said Winner Homes Wilson Road Subdivision, the southerly line of said Lot No. 2, a distance of 196.94 feet to a capped rebar (found) (Site Eng., Inc.) at the northwesterly corner of Lot 6, the northeasterly corner of Lot 7, both being numbered an delineated on the plat of said Winner Homes Wilson Road Subdivision;
Thence N. 68 deg. 24’47” E, with a southerly line of that 2.063 acre tract of land as described in a deed to System Capital Real Property Corporation, of record in Instrument 199710270127958, crossing said Lot No. 2, a distance of 160.22 feet to a capped iron pin (found) (P & L SYST. P.S. 6841) in the westerly limited access right-of-way line of Wilson Road, the westerly line of said Lot No. 2, the easterly line of said 13.416 acre tract;
Thence S. 24 deg. 19’40” E, with the westerly limited access right-of way line of Wilson Road, the westerly; line of said Lot No. 2, the easterly line of said 13.416 acre tract, a distance of 107.09 feet to the true point of beginning and containing 0.1967 acre of land, more or less.
All iron pins denoted as “set” are 5/8” (I.D.) X 30” iron pipe plugged with a plastic cap stamped “ELSCO S5519” and have been set by Erlenbach Land Surveying Company. All iron pins denoted as “found” have been set by others.
The basis of bearing the westerly limited access right-of-way line being S. 24 deg. 19’40” E as the same is denoted on the plat of Columbus West, of record in Plat Book 46, Page 65, Recorder’s Office, Franklin County, Ohio.
The foregoing description was prepared from information obtained from existing deed, plat and survey information also an actual field survey of the premises in accordance with Chapter 4733-37 Ohio Administrative Code by ERLENBACH LAND SURVEYING COMPANY.
EXCEPTING THEREFROM: Less and Excepting therefrom the following tract as conveyed by Auto Boutique Ltd LLC to the City of Columbus by Instrument No. 201907120085078: Situated in the State of Ohio, County of Franklin, City of Columbus, Virginia Military Survey No. 3316, being part of a parcel of land conveyed to Auto Boutique Limited (hereinafter referred to as “Grantor”) as recorded in Instrument No. 201901070001982 (Parcel No. 570-107944), Franklin County, Recorder’s Office, and being more particularly described as follows:
Commencing for reference at a 5/8 inch iron pin with a plastic identification cap found, said iron pin being the Northwesterly corner of Lot No. 6 of the Winner Homes Wilson Road Subdivision as recorded in Plat Book 33, Page 10, on the southerly line of Lot No. 2 of Columbus Park as recorded in Plat Book 46, Page 65, on the Southerly property line of a 2.063 acre parcel of land as conveyed to Archland Property I, LLC in Instrument No. 200406290149637 and the Grantor’s Northwesterly property corner;
Thence North 68 deg. 23’53” East along the Grantor’s Northerly property line, the Southerly property line of the aforementioned Arch Land Property I and through the aforementioned Lot No. 2 a distance of 160.14 feet to a 3/4 inch iron pipe found with a plastic identification cap, said pipe being on the westerly right-of-way line of Wilson Road (right of way width varies), the Southeasterly property corner of the aforementioned Archland Property I and the Grantor’s Northeasterly property corner;
Thence S. 24 deg. 23’50” E along the Easterly line of Lot No. 2, the Grantor’s Easterly property line and the Westerly right of way line of Wilson Road a distance of 106.83 feet to a point, said point being the Southeasterly corner of Lot No. 2, on the Northerly line of Lot No. 5 and the Northwesterly corner of a 0.052 acre (2265 Sq. Ft.) parcel of land conveyed to the State of Ohio in Deed Volume 3082, Page 601;
S. 30 deg. 05’31” E continuing along the Grantor’s Easterly property line and the Westerly right of way of Wilson Road a distance of 57.05 feet to an iron pin set, said iron pin being the TRUE POINT OF BEGINNING of the right to way acquisition;
Thence continuing S. 30 deg. 05’31” E along the Westerly right of way line of Wilson Road, the Westerly line of the aforementioned State of Ohio parcel and the Grantor’s Easterly property line a distance of 89.07 feet to an iron pin set, said pin being on the Westerly right-of way line of Wilson Road and the Northerly right of way line of Ferrell Place (60’ right of way width), on the southeasterly line of Lot No. 5, the Southern most corner of the aforementioned State of Ohio parcel and the Grantor’s Southeasterly property corner;
Thence along the Northerly right of way line of said Ferrell Place, the Southerly line of Lot No. 5 and the Grantor’s Southerly property line, with a curve to the right having a delta angle of 21 deg. 40’39”, a radius of 30.00 feet and a curve length of 11.35 feet a chord bearing S. 35 deg. 00’ 17” W and a chord distance of 11.28 feet to an iron pin set;
Thence N. 23 deg. 52’01” W through Lot No. 5 and the Grantor’s lands a distance of 94.38 feet to the point of beginning, containing 0.011 acres more or less (459.78 Sq Ft) and subject to all legal rights of way and/or easements of previous record.
All iron pins set are 5/8 inch diameter steel rod with a 1 1/4 inch plastic identification cap inscribed “CASSELL S-6378”.
The bearing system for this description is based on evidence found on the Westerly right of way line of Wilson Road and bears S. 24 deg. 23’50” E and is for the determination of angles only.
The description was prepared on June 5, 2019 by Jerry L. Cassell, Ohio Professional Surveyor No. 6378 and is based on an actual field survey of the premises in March of 2018 and existing public records.
To Rezone From: C-5, Commercial District,
To: C-4, Commercial District.
SECTION 2. That a Height District of thirty-five (35) feet is hereby established on the C-4, Commercial District on this property.
SECTION 3. That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said official zoning map in the office of the Department of Building and Zoning Services.
SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
