Explanation
Background: The City of Columbus, Department of Public Utilities, Division of Power and Water is undertaking design and construction of new facilities at the Dublin Road Water Plant located at the Utilities Complex on Dublin Road. A portion of this site has been utilized in the past as a railroad spur which was used for chemical delivery for the water treatment plant. However, chemicals are no longer delivered by rail and the railroad tracks have been removed. The City desires to purchase this property from the railroad to provide additional space for the upcoming construction. The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Dublin Road Capacity Increase Detailed Design Project, Project Number 690428-100001.
Fiscal Impact: The Department of Public Utilities, Division of Power and Water, has determined funding for this project will be from the Water Works Enlargement Voted Bonds Fund. An amendment to the 2010 Capital Improvements Budget is also necessary.
Emergency Justification: Emergency action is requested in order to provide for the immediate acquisition of real property interests necessary to the City's project in order to preserve public health, peace, property and safety.

To authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, to authorize a transfer and expenditure of $100,000.00 within the Water Works Enlargement Voted Bonds Fund, for costs in connection with the Dublin Road Capacity Increase Detailed Design Project, to authorize an amendment to the 2010 Capital Improvements Budget, and to declare an emergency. WHEREAS, the City of Columbus, Department of Public Utilities, Division of Power and Water is undertaking design and construction of new facilities at the Dublin Road Water Plant located at the Utilities Complex on Dublin Road; and
WHEREAS, a portion of this site has been utilized in the past as a railroad spur which was used for chemical delivery for the water treatment plant; and
WHEREAS, chemicals are no longer delivered by rail and the railroad tracks have been removed; and
WHEREAS, the City desires to purchase this property from the railroad to provide additional space for the upcoming construction; and
WHEREAS, the City of Columbus is engaged in the Dublin Road Capacity Increase Detailed Design Project; and
WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer and expend funds within the Water Works Enlargement Voted Bonds Fund; and
WHEREAS, it is necessary to authorize an amendment to the 2009 Capital Improvements Budget for purposes of providing sufficient funding and expenditure authority for the aforementioned project expenditure; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water, in that it is immediately necessary to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the aforesaid professional services necessary in connection with said project for the immediate preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Dublin Road Capacity Increase Detailed Design Project, Project No. 690428-100001.
SECTION 2. That the City Auditor is hereby authorized to transfer $100,000.00 within the Division of Power and Water, Dept/Div. No. 60-09, Water Works Enlargement Voted Bonds Fund, Fund No. 606, Object Level One 06, Object Level Three 6601, as follows:

SECTION 4. That the expenditure of $100,000.00, or so much thereof as may be necessary from the Water Works Enlargement Voted Bonds Fund, Fund No. 606, Dept./Div.60-09, Project No. 690428-100001 (carryover), OCA Code 664281, Object Level Three 6601, for the aforesaid purpose is hereby authorized.
SECTION 5. That for the reasons stated in the preamble hereto, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
