Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a construction administration and inspection services contract with R. D. Zande & Associates, Inc. The Division of Sewerage and Drainage has reviewed proposals from seven local firms, and is requesting City Council to authorize the award of a contract to the two highest ranking firms.
2. MULTI-YEAR CONTRACT:
This contract establishes fixed direct labor, overhead and fixed fee rates for the period of 2006-2008. This ordinance will authorize the expenditure of $380,145.45 of funds from two recently executed Ohio Water Development Authority (OWDA) Loans for three sanitary sewer projects that are scheduled to commence the during the first quarter of 2006. The Division anticipates requesting additional appropriations to this contract during the remainder of 2006, 2007 and 2008 fiscal years, through plannned contract modifications duly authorized by City Council. These planned modifications will occur as the City acquires funding for the construction contracts through the Ohio Water Development Authority. Under the terms of this contract, the City has the right to contract for additional services to fulfill emergency capital improvements related needs subject to the approval of a contract modification by City Council. The rates schedules established within this contract will remain in force throughout the life of the contract.
3. FISCAL IMPACT:
Funding for this project is derived through the use of construction loans from the OWDA that have been approved by its board. The appropriation of the loan proceeds have been requested and approved within the companion construction contract award legislation (ORD. 0067-2006 and 0059-2006).
4. EMERGENCY DESIGNATION:
The Division is requesting that this ordinance be made an emergency measure in order to expedite the establishment of the contract services that are necessary to ensure that the sanitary and combined sanitary sewer systems are being rehabilitated and/or replaced to ensure the continued operation of this vital infrastructure.

Zande & Associates, Inc., to authorize the expenditure of $380,145.45 from the Ohio Water Pollution Control Loan Fund; for the Division of Sewerage and Drainage, and to declare an emergency. WHEREAS, the Sewer System Engineering Section of the Division of Sewerage and Drainage have a consistent and immediate demand for cost-effective construction administration and inspection services so that its capital improvements projects are completed in accordance with the division's design requirements in order to ensure the continued operation of its sanitary, stormwater and combined sewer infrastructure; and
WHEREAS, the Division did undertake a successful Request for Proposal process in accordance with Section 329.12 of the Columbus City Codes in an effort to find two firms to provide an ongoing source of technical personnel to supplement existing city inspection personnel that are required to protect its customers investment in its sanitary sewer infrastructure; and
WHEREAS, based upon an evaluation of the seven proposals received for the two construction administration and inspection contracts to be awarded for the years of 2006-2008, utilizing a predetermined criteria, a selection comittee submitted the rankings to the Director of Public Utilities who determined that R. D. Zande & Associates, Inc., and DLZ Ohio, Inc., to be the highest ranking firms capable of providing the required services; and
WHEREAS, the Ohio Water Development Authority has approved two loans that will fund the construction of the Torrence/Colerain Area Sanitary Improvements Project; the Piedmont/High Area Sanitary Improvements Project; and the Orchard/Milton Area Sanitary Improvements Project; and that said loans also include funding for the construction administration and inspection services requested within this ordinance; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities in that it is immediately necessary to authorize the Director of Public Utilities to enter into contract with R. D. Zande & Associates, Inc., for the construction administration and inspection services for the projects listed within Section 3 herein, which are necessary to allow for the proper operation of the City's sanitary and combined sewer infrastructure, for the preservation of the public peace, health, property and welfare; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities be, and hereby is, authorized to award and execute a professional engineering services agreement with R. D. Zande & Associates, Inc., 1500 Lakeshore Drive, Columbus, Ohio 43204, that will provide construction administration and inspection services for sewer improvement projects in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Sewer System Engineering Section.
Section 2. That the said services shall be performed to the satisfaction of the Director of Public Utilities, the Administrator of the division of Sewerage and Drainage, and the Division of Sewerage and Drainage's Sewer System Engineering Manager.
Section 3. That the expenditure of $380,145.45, or as much thereof as may be needed, be and the same is hereby authorized from the Ohio Water Pollution Control Loan Fund, as follows:

Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby decleared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
