Explanation
Various types of utility excavations are performed within the City of Columbus' right-of-way by contractors and/or utilities.  These entities obtain street opening permits whose fees are used to mitigate the City's cost of restoring these excavations.  The Transportation Division routinely contracts this restoration work with a contractor that is equipped and trained to make these repairs to damaged items such as pavement, curb, and sidewalk in a proper and consistent manner.  A $450,000.00 contract with Decker Construction Company was authorized by Ordinance 0688-2005 passed by City Council on May 23, 2005.  This contract was initially jointly funded by the Transportation and Sewerage and Drainage Divisions.   The contract specifications provide for the City establishing the contract amount based on its available funding using the contractor's bid unit costs.  It has been determined that an additional $32,320.56 is required from the Sewerage and Drainage Division to cover anticipated contract billings.
 
Decker's contract compliance number is 31-0983557 and expires July 7, 2006.    
 
Fiscal Impact:  The sum of $32,320.56 is budgeted and available within the Sewerage and Drainage Division's Sanitary Operating Fund for this purpose.  Including this modification, $1,697,320.56 will have been spent over the past four years for this work.
 
Emergency action is requested due to the extreme hazard that improperly repaired excavations pose to motorists.

Body
WHEREAS, the Transportation Division has various types of utility excavations in the public right-of-way that require different levels of restoration; and
 
WHEREAS, the focus of the Utility Cut and Restoration - 2005 project is to repair damaged items such as pavement, curbs and sidewalks caused by right-of-way excavations to repair underground facilities; and
 
WHEREAS, the Utility Cut and Restoration - 2005 project was competitively bid on March 24, 2005; and
 
WHEREAS, Ordinance 0688-2005 passed by City Council May 23, 2005, authorized a $450,000.00 contract with Decker Construction Company for this purpose; and
 
WHEREAS, It has been determined that an additional $32,320.56 is required from the Sewerage and Drainage Division to cover anticipated contract billings; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to modify and increase this contract in order to reduce or eliminate the extreme hazard that improperly repaired excavations pose to motorists, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase existing contract EL005429 with Decker Construction Company, 3040 McKinley Avenue, Columbus, Ohio 43204 for the Utility Cut and Restoration - 2005 project in accordance with the terms as shown on the plans on file in the office of the City Engineer, which are hereby approved.
 
SECTION 2.  That for the purpose of paying the costs of the Utility Cut and Restoration - 2005 project contract modification, the sum of $32,320.56 or so much thereof may be necessary be and hereby is authorized to be expended from Fund 650, the Sanitary Operating System Fund, Department No. 60-05, Sewerage and Drainage Division, Object Level One Code 03, Object Level Three Code 3375 and OCA Code 605089.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
