Explanation
BACKGROUND: This legislation authorizes the Finance and Management Director to extend an existing Universal Term Contract (UTC) for the option to obtain Transformers with Springfield Electric Supply Co. LLC, dba Echo Electric, CC# CC-052934, expires on 6/23/2027. This contract provides for outdoor medium-voltage electric distribution transformers and secondary network protectors. The Division of Power is the sole user of Transformers UTC. Contract #PO346416 was established in accordance with Request for Quotation #RFQ022251 and will expire on April 30, 2026. Ordinance number 2354-2022 listed a contract expiration date of April 30, 2025, with the option to renew for one (1) additional year. However, the executed contract has an option to renew for two (2) additional years in accordance with RFQ022251. This extension is necessary to maintain an uninterrupted supply of Transformers, and to extend the contract through April 30, 2027, as noted in the contract.
Pursuant to Section 329.09(a) of Columbus City Codes:
(1) Amount of additional funds to be expended under the modification: No additional funding will be immediately necessary.
(2) Why the need for additional goods or services could not be foreseen at the time the contract was initially awarded: N/A
(3) Why it would not be in the city's best interests to have the additional contract requirements awarded through other procurement processes specified in this chapter: N/A
(4) How the price for the additional goods or services which are the subject of the modification was determined: N/A
EMERGENCY DESIGNATION: The Finance and Management Department respectfully requests this legislation be considered an emergency to enter into a contract with Springfield Electric Supply Co. LLC, dba Echo for one (1) additional year to maintain an uninterrupted supply of Transformers, outdoor medium-voltage electric distribution transformers and secondary network protectors; and to extend the contract to and including April 30, 2027, as noted in the executed contract.
FISCAL IMPACT: No funding is required to extend the option contract. The Department of Power must set aside their own funding for their estimated expenditures.

WHEREAS, the Purchasing Office entered into a Universal Term Contract for Transformers for use by the Division of Power; and
WHEREAS, it is necessary to extend the existing Universal Term Contract with Springfield Electric Supply Co. LLC, dba Echo Electric, to purchase outdoor medium-voltage electric distribution transformers and secondary network protectors for use within the service area.
WHEREAS, this contract was authorized by Ordinance No. 2354-2022; with a one (1) year renewal option. A two (2) year renewal option is available as stated in the contract established in accordance with RFQ022251; and,
WHEREAS, an emergency exists in the usual daily operation of the Department of Power in that it is necessary to authorize the Finance and Management Director to immediately extend the Universal Term Contract with Springfield Electric Supply Co. LLC, dba Echo Electric for one (1) additional year as stated in the contract to ensure transformers, outdoor medium-voltage electric distribution transformers, and secondary network protectors are readily available to and including April 30, 2027, for the immediate preservation of the public health, peace, property, safety, and welfare; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Finance and Management Director is hereby authorized to modify and renew the option contract to obtain Transformers with Springfield Electric Supply Co. LLC, dba Echo Electric for one (1) additional year to and including April 30, 2027, in accordance with the contract established with RFQ022251.
SECTION 2. That this contract modification and renewal is in accordance with relevant provisions of Chapter 329 of the Columbus City Codes.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
