Title: To authorize the Director of Finance and Management to enter into a contract with Path Master Inc. for rectangular rapid flashing beacon commodities for the Division of Mobility Options in the amount up to $104,380.00; to amend the 2012 Capital Improvement Budget; to authorize the transfer and expenditure of $104,380.00 within the Streets and Highways G.O. Bonds Fund; and to declare an emergency ($104,380.00).
Explanation
1. BACKGROUND
The Department of Public Service, the Division of Mobility Options is responsible for crosswalk improvements to promote and address pedestrian safety issues throughout the City. To accomplish this, rectangular rapid flashing beacons are to be installed in various locations throughout the City.
 
The Purchasing Office opened formal bids on July 12th, 2012 for the purchase of rectangular rapid flashing beacons (SA004477). Seven (7) bids were received.

Lower bids were received by Graybar Electric Co., Inc. on items 3, 4, 7, 8 and 11B but did not meet specifications. Baldwin & Sours, Inc. was the low bidder for item 15 but the bid stated the items would be awarded to the overall low bidder for the system. The lowest and best bid received was from Path Master Inc. and their bid met specifications as the lowest responsive, responsible bidder.
This legislation authorizes the Director of Finance and Management to enter into contract with Path Master Inc. to purchase commodities for this cause in the amount up to $104,380.00
Searches in the Excluded Party List System (Federal) and the Findings for Recovery list (State) produced no findings against Path Master Inc.
2.  CONTRACT COMPLIANCE:
The contract compliance number for Path Master Inc. is 341233777 and expires 06/11/2014.
3.  EMERGENCY DESIGNATION
Emergency action is requested so that installation of rectangular rapid flashing beacons can start as soon as possible.
 
4.  FISCAL IMPACT
Funds are budgeted in the 2012 C.I.B.  It is necessary to transfer funds and amend the 2012 C.I.B.

WHEREAS, the Department of Public Service, the Division of Mobility Options is responsible for crosswalk improvements to promote and address pedestrian safety issues throughout the City; and
 
WHEREAS, the Division of Mobility Options is in need of rectangular rapid flashing beacons for this project, and
WHEREAS, funds are available in the Streets and Highways G.O. Bonds Fund for this expense; and
 
WHEREAS, it is necessary to amend the 2012 C.I.B to establish proper authority for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, in that it is immediately necessary to establish funding for these materials in order to meet the expiration dates of the bids for these commodities, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Finance and Management be and is hereby authorized to enter into a contract with Path Master Inc., 1960 Midway Dr. Twinsburg, OH 44087 in an amount up to $104,380.00 for rectangular rapid flashing beacons.
 
SECTION 2.  That the 2012 Capital Improvement Budget established within ordinance 0368-2012 be and hereby is amended as follows:

SECTION 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
