Rezoning Application Z08-055

 

APPLICANT:  City of Columbus, Development Department, Land Redevelopment Office; c/o John Turner, Agent;  109 North Front Street, Columbus, Ohio  43215.

                     

PROPOSED USE:  Public Parking lot.

 

NEAR EAST AREA COMMISSION RECOMMENDATION:  Approval.

 

DEVELOPMENT COMMISSION RECOMMENDATION: Approval (7-0) on January 8, 2009.

                                                                               

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The Applicant requests the CPD, Commercial Planned Development District to permit the development of a public parking lot.  The CPD text provides for adequate screening of the parking from adjacent dwellings.  The proposed CPD District is consistent with the land use patterns of the area and furthers the goals of the Near East Plan (2005).

WHEREAS, application #Z08-055 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.16± acres from R-2F, Residential District to CPD, Commercial Planned Development District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the Near East Area Commission recommends approval of said zoning change; and

 

WHEREAS, the Columbus Public Health Healthy Places program recognizes this development is a parking lot an urban, walkable neighborhood and the applicant has agreed to provide texturized sidewalks or signage at the entrance/exit of the parking lot to alert drivers to pedestrians on the sidewalk; and

 

WHEREAS, the City Departments recommend approval of said zoning change because Applicant requests the CPD, Commercial Planned Development District to permit the development of a public parking lot.  The CPD text provides for adequate screening of the parking from adjacent dwellings.  The proposed CPD District is consistent with the land use patterns of the area and furthers the goals of the Near East Plan (2005); and

 

WHEREAS, said ordinance requires separate submission for all applicable permits for the proposed use; and

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

Situated in the State of Ohio, County of Franklin, and the City of Columbus, located in "John W. Baker's" Subdivision of record in Plat Book 1, Page 59, being a 0.16 acre tract out of the lands conveyed to the City of Columbus in Instrument Numbers 200306270125637, 200307250231966, & 200703210048779, and being more particularly described as follows:

 

Commencing at the intersection of the southerly right-of-way line of Long Street (70 feet in width) with the westerly right-of-way line of Seventeenth Street (50 feet in width), also being the northeasterly property corner of a tract of land conveyed to Alpha Investments I LLC in Instrument Number 200406250148003;

 

Thence South 00 degrees 08 minutes 06 seconds East, along the said westerly right-of-way line, a distance of 25.02 feet to a point at the northeasterly corner of Lot 31 of the said subdivision, being the northeasterly property corner of the said City of Columbus tracts, also being the Point of Beginning of the tract herein described;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the CPD, Commercial Planned Development District on this property.

I.  Introduction:

 

                     The subject property consists of .186 acres, and is made up of five (3) separate parcels.  The subject property consists of one vacant single-family dwelling and two vacant lots. The properties located to the North, and West of the subject property are developed with commercial uses within the R2-F zoning district.  A single-family dwelling is located to the south of the site, also in the R2-F zoning district.  The area was subject to an area wide rezoning in 1974.  To allow for the construction of the proposed development, the existing vacant single-family dwelling will be demolished.

 

II.  Permitted Uses:

 

                     Unless otherwise indicated herein, the permitted uses in, on or upon the subject property shall be those allowed in P-2 Public Parking Districts as set forth in Columbus Zoning Code § 3373.01.

 

III.  Development Standards:

 

A.                     Density, Lot, and/or Setback Commitments.

 

1.                     The parking setback along the north and west property lines shall be zero.  The parking setback line shall be a minimum of 10 feet from the 17th St right-of-way.

 

2.                     The parking setback along the south property line shall be a minimum of 5 feet, measured from the existing adjacent house and provided the use of the property remains residential.  At such time the use changes to a parking lot, the setback shall be zero.

 

3.                     The subject property conforms to the standards and dimensions set forth in the site plan attached hereto and marked as "Long Street and 17th Parking Lot". 

 

B.                     Access, Loading, Parking, and/or Other Traffic Related Commitments

 

1.                     Parking area is surfaced with blacktop, with drainage according to the City of Columbus' specifications and requirements.

 

2.                     Signage and/or texturized sidewalks at points where cars cross the sidewalk to alert drivers of pedestrian traffic.

 

 

C.                     Buffering, Landscaping, Open Space and/or Screening Commitments.

 

1.                     The parking lot shall be screen along the south property line by a minimum 6' cedar privacy fence.  In addition, to prevent cross access between the site and the adjacent parcel to the west, a minimum 6' foot privacy fence will be installed between the south property line and the dumpster enclosure (as shown on Site Plan).  This fence may be removed upon the redevelopment of 879 E. Long Street (the adjacent parcel).  No screening shall be required along the north property lines.

 

2.                       Landscaping shall be installed along the 17th St. frontage and shall consist of headlight screening with evergreen or other suitable plant material not less than three feet in height and minimum of two (2) street trees, as shown on the site plan. 

 

 

D.                     Building Design and/or Interior-Exterior Commitments.

 

1.                     N/A

 

E.                     Dumpsters, Lighting, Outdoor Display Areas and/or other Environmental Commitments.

 

1.                     A dumpster may be located on the site and shall be screened from view from all sides.

 

2.                     Lighting fixtures will be installed at the locations illustrated on the Site Plan and will meet the following specifications:

 

a.                     Light standards shall not exceed 18 feet.

b.                     Lights shall have fully shielded, recessed lamps directed downward to prevent glare and shine above the horizontal plane.

c.                     Lights shall be of the same or similar type and color.

 

 

F.                     Graphics and Signage Commitments.

 

                     All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.

 

IV.  CPD Criteria:

 

A.                       Natural Environment:  This sit is located within the King-Lincoln District and consists of three lots. 

 

B.                     Proposed Development:  A parking lot to serve the King-Lincoln District.

 

C.                     Existing Land Use:  The site contains three parcel, one parcel is developed with a vacant single-family house, the other two parcels are currently vacant.  A two-family dwelling was demolished on the site.

 

D.                     Transportation and Circulation:  All circulation, curb cuts, and access points have been approved by the Division of Traffic, Engineering and Parking.

 

E.                     Visual Form of the Environment:  The site will be a parking lot, which will be screened from an adjacent single-family dwelling and landscaping shall be installed within the parking setback along 17th St.

 

F.                     View and Visibility: The site will include landscaping as described above.

 

G.                     Emissions: Emissions from the site will not substantially affect the environment of the surrounding neighborhoods. 

 

H.                     Behavior Patterns: The site shall be used for company vehicles and employee parking during daytime business hours.

 

V.  Variances from Standards.

 

1.                     Front, side and rear setback requirements enumerated in Columbus City Code 3361.04, whereas Section 3361.04 sets a minimum twenty five-foot setback unless otherwise specified and made a part of the rezoning ordinance.  The parking setback is established at zero from the north and west property lines, a five foot setback is established from the adjacent structure to the south (note: the setback is established from the adjacent structure to accommodate of future adjustment of the property line), the parking setback is established as ten feet along the frontage.

 

2.                     Screening requirements set forth in Columbus City Code § 3342.17 as shown on Site Plan, whereas Section 3342.17(a) requires parking lot screening from adjacent residentially zoned properties, the Site Plan establishes no screening from the north and west (except as provided in C (1)).

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
