Explanation
As consistent with Nationwide Children's Hospital ("Hospital") master plan for redeveloping its surrounding area, it is necessary for the Hospital to acquire certain adjacent City owned property in order to re-align portions of the roadway. The reconfiguration will create a traffic circle at Ann Street and Children's Drive, which will improve the flow of hospital traffic. The Hospital proposes to convey a 0.045 acre +/- to the City of Columbus in exchange for a 0.038 acre +/- necessary to the roadway's reconfiguration. The Recreation and Parks Department has determined that the exchange would not adversely affect the City of Columbus and the changes have been included in the master plan for Livingston Park, and should be allowed at no charge. This legislation authorizes the Director of the Recreation Department to execute those documents necessary to the exchange of the subject real properties.

Emergency Justification: Emergency action is requested to allow for the immediate realignment of Ann Street and Children's Drive, which will improve the flow of hospital traffic, thereby preserving public health, peace, property, safety, and welfare.

To authorize the Director of Recreation and Parks Department to execute those documents, on behalf of the City, necessary to exchange certain real property with Nationwide Children's Hospital for the reconfiguration of its adjacent roadway in order to improve the flow of traffic surrounding the hospital, to waive the Land Review Commission provisions of the Columbus City Codes (1959) and to declare and emergency.

WHEREAS, Nationwide Children's Hospital ("Hospital") is engaged in its master plan to redevelop the area surrounding the hospital; and
WHEREAS, it is necessary for the Hospital to acquire certain adjacent City owned property in order to re-align portions of the roadway; and
WHEREAS, the reconfiguration will create a traffic circle at Ann Street and Children's Drive, which will improve the flow of hospital traffic; and
WHEREAS, the Hospital proposes to convey a 0.045 acre +/- to the City of Columbus in exchange for a 0.038 acre +/- necessary to the roadway's reconfiguration; and
WHEREAS, the Recreation and Parks Department has developed a master plan for the park and included the reconfigured property and has determined that the exchange would not adversely affect the City of Columbus and should be allowed; and
WHEREAS, it has been determined by the Recreation and Parks Department that it is in the best interest of the City of Columbus to improvement the Hospital's traffic flow, and that the exchange would not adversely affect the City and should be allowed; and
WHEREAS, the exchange will equitably benefit both the City and the Hospital, therefore no exchange of money will be involved; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department, in that it is necessary to authorize the Executive Director of the Recreation and Parks Department to execute those documents, on behalf of the City of Columbus, necessary to convey certain real property, more fully described in the body of this legislation, with Nationwide Children's Hospital, in exchange for a replacement property of greater acreage, for the preservation of the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City of Columbus hereby accepts the following describe real property to be used for park purposes:

City of Columbus, lying in Section 15, Township 5, Range 22, Refugee Lands, being part of the 2.715 acre tract conveyed to Nationwide Children's Hospital by deed of record in Instrument Number 200712310221603, (all references are to the records of the Recorder's Office, Franklin County, Ohio) and being more particularly described as follows:
Beginning, for reference, at the northeasterly corner of Parcel 1 of "Children's Hospital Urban Renewal Area, Plat A", a subdivision of record in Plat Book 43, Page 17, as conveyed to City of Columbus by deeds of record in Deed Book 2573, Page 666, Deed Book 2549, Page 10, Deed Book 2542, Page 207, Deed Book 2526, Page 282, Deed Book 2615, Page 270, Deed Book 2615, Page 272, Deed Book 2638, Page 380, Deed Book 2515, Page 1, Deed Book 2638, Page 386, Deed Book 2613, Page 221, and Deed Book 2571, Page 184;

Section 3. That this Council has determined that it is in the best interest of the City of Columbus to waive and does hereby waive the requirements of Columbus City Codes (1959) Revised, Chapter 328 (Land Review Commission) and Section 329.29 (competitive bidding) to the extent that they may apply to this transaction with regards to this transaction only.
Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
