PROPOSED USE:  Warehouse and office development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0) on May 8, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The applicant requests the L-M, Limited Manufacturing District to make an office and warehouse building that is zoned in the R-Rural District a conforming use.  The office/warehouse building was developed prior to 1979, the year the site was annexed into the City of Columbus and zoned in the R-Rural District.  The prior property owner did not seek a comparable rezoning at that time.  A site plan has been prepared to identify existing conditions on the site and if desired, the property owner may apply to the Board of Zoning Adjustment to vary any M, Manufacturing District development standards that are not met by existing conditions.

WHEREAS, application #Z02-100 is on file with the Building Services Division of the Department of Development requesting rezoning of 4.14± acres from R-Rural District to L-M, Limited Manufacturing District.
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval because the applicant requests the L-M, Limited Manufacturing District to make an office and warehouse building that is zoned in the R-Rural District a conforming use.  The office/warehouse building was developed prior to 1979, the year the site was annexed into the City of Columbus and zoned in the R-Rural District.  The property owner did not seek a comparable rezoning at that time.  A site plan has been prepared to identify existing conditions on the site and if desired, the property owner may apply to the Board of Zoning Adjustment to vary any M, Manufacturing District development standards that are not met by existing conditions.; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
845 HARRISBURG PIKE (43223), being 4.14± acres located on the west side of Harrisburg Pike, 290± feet the south of Withers Avenue, and being more particularly described as follows:
 
PARCEL ONE
 
Being 0.837 acres out of Woodrow Subdivision (now located) of record in Plat Book 18, Page 59, Franklin County, Recorder's Office.  Said 0.837 acre tract being more particularly described as follows:
 
Beginning at a point in the westerly right-of-way of Harrisburg Pike (60 feet in width), the northeasterly corner of said Woodrow Subdivision; thence S 32° 56' W, with the said westerly line of Harrisburg Pike, a distance of 24.56 feet to an iron pin;
 
Thence N 57° 04' W, at right angles to the centerline of said Harrisburg Pike, a distance of 270 feet to an iron pin;
 
Thence N 32° 56' W, parallel to and 300 feet westerly from the centerline of Harrisburg Pike, a distance of 245.60 feet to an iron pin in the northerly line of said Woodrow Subdivision.
 
Thence S 17° 45' 40" E, with the said northerly line of Woodrow Subdivision, a distance of 348.94 feet to the place of beginning, containing 0.837 acres of land, more or less.

Situated in the City of Columbus, Township of Franklin, County of Franklin, State of Ohio, being part of a 3.3 acre tract of land conveyed to Olin L. Parrett by deed of record in Deed Book 1482, page 488, Recorder's Office, Franklin County, Ohio and being part of a 9-1/3 acre tract of land conveyed to Olin L. Parrett by deed of record in Deed Book 1939, page 401, Recorder's Office, Franklin County, Ohio, and being more particularly described as follows:
 
Beginning at a spike in the centerline of Harrisburg Pike, being the southerly corner of the said 3.3 acre tract and a northeast corner of the Woodrow Subdivisio0n of record in Plat Book 18, page 59, said Recorder's Office;
 
Thence with the southwest line of said 3.3 acre tract and the southwest line of the herein described tract
 
North 17° 45' 40" West a total distance of 615.17 feet to an iron pin, passing an iron pin at 38.78 feet; thence crossing said 3.3 acre tract and entering said 9-1/3 acre tract, and with the northwest line of the herein described tract
 
North 32° 56' 00" East a total distance of 158.95 feet to an iron pin; thence with a northeast line of the herein described tract

I.  INTRODUCTION:
 
When this property was annexed to the city, it defaulted to the R-Rural, Residential District, and the prior owner did not rezone thereafter.  It has been used for office and warehouse purposes since it was annexed.  Applicant seeks only to rezone existing buildings and activities to conform to the city's zoning ordinances.
 
The property previously consisted of two parcels.  It has been combined into one parcel with PID #570-184221.  A copy of the lot combination request has been provided to city staff.
 
II.  PERMITTED USES:
 
Permitted uses for the property are those uses listed in C.C. 3363.01, Manufacturing Districts, C-2 uses, C.C. 3363.02 through 3363.08, Warehouse, storage and sales establishment - Less objectionable uses, and C.C. 3363.175, Telecommunication antennas.
 
III.  DEVELOPMENT STANDARDS:
 
A.  Density, Lot, and/or Setback Commitments.
 
1.  Building Setback:  The existing building was constructed prior to annexation of this site into the City of Columbus.  The building setback is a legal, non-conforming condition to the extent that it does not meet the requirements of C.C. 3363.24, Building lines in an M-manufacturing district.
 
2.  Parking Setback:  Existing parking and maneuvering are shown on the site plan titled "SITE PLAN FOR ZONING PURPOSES" and are considered to be legal, non-conforming conditions to the extent that they do not meet the requirements of C.C. 3342, Off-Street Parking and Loading.
B.  Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
Access.  Unless otherwise required or approved by the City of Columbus Transportation Division, existing access shall be maintained as shown on the site plan titled "SITE PLAN FOR ZONING PURPOSES".
 
C.  Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
Existing landscaping, including six (12) Silver Maple street trees shall be maintained.  Landscaping shall be maintained in a healthy state.  Any dead material shall be removed and replaced with like materials (tree species shall not be mixed) at the next planting season or within six (6) months, whichever occurs sooner.  The minimum caliper of any replaced trees shall be:  2.5" for deciduous trees and 1.5" for ornamental trees.  Tree caliper is to be measured six (6) inches above the ground.  
 
D.  Building Design and/or Interior-Exterior Treatment Commitments:  N/A.
 
E.  Dumpster, Lighting, Outdoor Display Areas, and/or Other Environmental Commitments.
 
1.  All new external outdoor lighting shall be cut-off fixtures (down lighting) and shall be designed and placed to prevent spillage of light off the site and to prevent glare visible from the property lines and lighting shall not exceed .1 foot-candle along the property line of a residually used or zoned property.
 
2.  All new exterior lighting shall be from the same or a similar manufacturer's type and style to insure aesthetic compatibility.  
 
3.  All new parking lot lighting for automotive spaces shall be no higher than eighteen (18) feet.
 
F.  Graphics and/or Sign Commitments.
 
The applicable graphics standards shall be those contained in Columbus City Code Article 15 as they apply to the M, Manufacturing District.  Any variances or special permits shall be subject to review and approval of the City of Columbus Graphics Commission.
 
G.  Miscellaneous Commitments.
 
1.  The applicant may apply to the Board of Zoning Adjustment (BZA) to request variances for M, Manufacturing District development standards.
 
2.  The applicant will pay the required fee in the amount of $400.00 per acre to the Division of Recreation and Parks in lieu of parkland dedication within six (6) months of the date that this ordinance becomes law.
 
 
Section 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
