Explanation
1. BACKGROUND.
This legislation authorizes the Director of Public Utilities to execute a professional engineering services contract modification with R.D. Zande & Associates, Inc., for additional construction design services that were performed for four sanitary sewer improvement projects in the North Linden community. These projects include the Atwood Terrace/Lenore Ave. Sanitary Relief Project; the Atwood Terrace/Northridge Rd. Sanitary Relief Project; the Weldon Avenue Sanitary Relief Sewer Project; and the Lenore Ave./Huy Rd. Sanitary Relief Sewer Project.
This contract modification will provide for the payment of additional services that were requested by the Division of Transportation to incorporate the design and construction of American with Disability Act (ADA) handicap ramps; and pavement replacement. By incorporating this additional work with the existing sewer project, the City was able to siginificantly reduce the impact of the combined projects upon the neighborhood's residents; and to take advantage of cost savings of the single construction project procurement. This is a logical and cost effective extension of the design responsibilities of R.D. Zande & Associates and will enable the additional work to proceed without delaying the completion of the project.
2. FISCAL IMPACT.
The Division is requesting fund transfer authority within this ordinance, in order to provide for this expenditure. Project accounts from which funds are being transferred will not be adversely affected, as they were residual funds from previous project encumbrances that are no longer required.

WHEREAS, Ordinance No. 0543-2003, as passed April 7, 2003, authorized the Director of Public Utilities to enter into a professional engineering services contract with R. D. zande & Associates, In., for the preparation of construction plans and specifications for four sanitary sewer improvement projects located in the North Linden community; and
WHEREAS, the Division of Transportation, Department of Public Service, reviewed the Division of Sewerage and Drainage's plans for the aforementioned improvements, and requested the Division to revise their plans for purposes of incorporating roadway improvement features that include handicap ramps and pavement replacement; and
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined it to be in the best interest of the City of Columbus to incorporate this additional design work into its contract with R. D. Zande & Associates, Inc.; and
WHEREAS, it is therefore necessary for the Division of Sewerage and Drainage, Department of Public Utilities, to request this City Council to authorize the Director of Public Utilities to modify the subject contract for purposes of increasing the existing scope of services and to allow for the increased cost of said services, at the earliest practicable date, now, therefore,

Section 1. That the City Auditor be and hereby is authorized and directed to transfer a total of $28,000.00 from within the Voted Sanitary Bond Fund No. 664, Department 60-05, Obj. Level Three 6676, as follows:

Section 2. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 3. That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL003396 with R. D. Zande & Associates, Inc., 1500 Lake Shore Drive, Suite 100, 43204, in order to provide for the payment of additional design services required to successfully complete the aforementioned sanitary sewer improvement projects in the North Linden community, in accordance with the terms and conditions as shown in the contract modification on file in the office of the Division of Sewerage and Drainage.
Section 4. That for the purpose of paying the cost of the aforementioned professional engineering contract modification, the expenditure of $28,000.00, is hereby is authorized within Division 60-05, as follows:

Section 6. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
