Explanation
1. BACKGROUND:
This ordinance will provide an increase of $15,000.00 in funding that is necessary for the City Attorney to complete the acquisition of an easement that is required for the Division of Sewreage and Drainage's maintenance forces to access the Alum Creek Sanitary Trunk Sewer Storage facilities that are located southeast of the corner of East Main Street and Alum Creek Drive.
2. FISCAL IMPACT:
The Division is requesting City Council to transfer residual funds from an existing account balance within the Voted Sanitary Bond Fund that no longer requires funding. An amendment to the 2005 Capital Improvements Budget is necessary to accomodate the reallocation of residual funds from within the Voted Sanitary Bond Fund. Total funding for easement acquisition services for this project now stands at $25,000.00, with this increase.

Body
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities, operates and maintains the Alum Creek Sanitary Trunk Sewer Storage Facility, that is located southeast of the interesection of East Main Street and Alum Creek Drive and has determined it necessary to acquire an easement to provide access for its maintenance forces to provide preventative service to said facilities; and
WHEREAS, Ordinance No. 0397-2005, as passed by Columbus City Council on March 28, 2005, provided initial funding in the amount of $10,000.00 for purposes of enabling the City Attorney to provide easement acquisition services for the subject project; and
WHEREAS, Resolution 0008X-2006, adopted February 6, 2006, declared the necessity and intent to appropriate permanent easements required for the aforementioned project; and
WHEREAS, it has been determined necessary by the Division of Sewerage and Drainage, Department of Public Utilities, on advice by the City Attorney's Real Estate Section, that this City Council should authorize the funding necessary to complete the acquisition of an easement necessary for the Division to adequately maintain the Alum Creek Sanitary Trunk Sewer Storage Facility; at the earliest practicable date allowed by law; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to transfer $15,000.00 within the Voted Sanitary Bond Fund No. 60-05| Department 60-05, in order to fund the Alum Creek Sanitary Trunk Sewer Storage Facility Project, as follows:

Section 2. That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
Section 3. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Alum Creek Sanitary Trunk Sewer Storage Facility Project.
Section 4. That the City Attorney be and hereby is authorized to expend $15,000.00, or so much thereof as may be necessary, in order to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary, from the Voted Sanitary Bond Fund No. 664; Division 60-05; MOC 6601; within the following project:

Section 5. That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, in order to provide sufficient budget authority for the aforementioned easement acquisition services as referenced in the preamble hereto.
