Explanation
BACKGROUND: This resolution withdraws the 2007 objection to the liquor permit renewal for Allure Gentleman's Club. The withdrawal of this objection is desired due to a change in and circumstances upon which the objection was based, and due to new information that was either unknown or unavailable to Council at the time of the objection.
Columbus City Council objected to the renewal of the liquor permit for Allure Gentleman's Club, 340 Greenlawn Ave., Columbus, OH 43223, in part, because the liquor permit holder of record had been enjoined from holding a liquor permit or from having any interest in a liquor establishment. However, at the time Council voted to object to the liquor permit renewal, the body was unaware of ongoing efforts to have the permit transferred to the property owner. This process was slowed by unrelated pending legal action against the permit holder by the property owner. Since that time, the unrelated legal impediments to the transfer of the liquor permit have been resolved, the property owner has assumed control of the establishment and has made substantial improvements.
It is desirable for City Council to withdraw its objection so that the liquor permit might be transferred to the property owner, and to allow the property owner to operate the improved establishment in accordance with the law and for the benefit of the surrounding community and the local economy. The property owner has made significant efforts to bring the establishment into line with community standards, and has made a good faith effort to cooperate with the City Attorney.
Columbus City Council reserves its right to again object to any future renewals of this liquor permit should present facts and circumstances change.

WHEREAS, City Council desires to withdraw its objection that was made on December 10, 2007 pursuant to 4303.271 and 4303.292, Ohio Revised Code to the renewal of the liquor permit for Allure Gentleman's Club, 340 Greenlawn Ave., Columbus, OH 43223; and
WHEREAS, an emergency exists in the usual daily operation of the city, in that it is immediately necessary to withdraw the objection to this permit to preserve the public health, peace, property, safety and welfare; now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Columbus City Council hereby withdraws its objection made on December 10, 2007 in resolution 0206X-2007, pursuant to state statute to the renewal of the liquor permit for Allure Gentleman's Club, 340 Greenlawn Ave., Columbus, OH 43223.
Section 2. That the City Clerk be and hereby is directed to forward a certified copy of this resolution to the director of the Ohio Department of Liquor Control.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this resolution is declared to be an emergency measure and shall take effect and be in force from and after its adoption of the Mayor neither approves nor vetoes the same.
