Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into contract with Darby Creek Excavating, Inc., for the construction of the Hilock/Lewis Roads Assessment Sewer Project, and to pay a maximum of $826,223.52 for the construction contract; $17,507.49 interest on residents share; and $123,933.53 for the cost of the construction administration and inspection services with the Dept. of Transportation.
 
2.  BID INFORMATION:
The Director of Public Utilities publicly opened three competitive bid proposals on May 9, 2007.  The results of these bids were: Tata Excavating, Inc. ($1,146,787.63), Nickolas M. Savko & Sons ($1,158,406.73), and Darby Creek Excavating, Inc. ($826,223.52).  Bid is recommended to the lowest, best, responsive and responsible bidder.
 
3.  FISCAL IMPACT:  
This project is being constructed in accordance with the special assessment provisions of the Columbus City Codes.  This legislation includes a transfer of cash between the Sanitary Sewer Bond Fund (664) and the Sanitary Sewer Assessment Fund (662), and the amendment of the 2007 Capital Improvements Budget to establish sufficient funds and budget authority to cover the City's portion of the required expenditures upon passage of this ordinance.  Funding for this project is being provided by a note from the City of Columbus's Treasury Investment Board (Ord. 0501-2007).  Upon completion of the project, property owners will be notified of their final assessment for the improvements.  After payments have been accounted for, the City will bond the remaining balance of the property owners share of the project.  This bond will then be retired from proceeds from the special assessment receipts included within the individual property owner's property tax bill over a ten year period.
 
4.  EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is requesting Council to consider this measure an emergency measure for purposes of immediately causing the procurement of the construction services that are necessary to install the urgently required sanitary sewer system that is needed for the residential properties that have failing on-site sewer systems.

Body
WHEREAS, Resolution 140X-95, adopted on July 31, 1995, by Columbus City Council declared it necessary to cause the preparation of plans, profiles, specifications and estimate of cost for the Hilock Road/Lewis Road Assessment Sewer, Part 2 Project; and
 
WHEREAS, pursuant to Ordinance 1010-2003 adopted June 16, 2003, this Council determined to proceed with the sanitary sewer project described below in accordance with Resolution 140X-95 adopted by this Council on July 31, 1995
 
WHEREAS, three competitive bids for construction of the Hilock/Lewis Roads Assessment Sewer Project were received on May 9, 2006; and
 
WHEREAS, it is necessary to authorize an amendment to the 2007 Capital Improvements Budget for purposes of providing sufficient budget authority for the necessary project expenditure; and
 
WHEREAS, it is necessary to transfer funds from the Sanitary Sewer Bond Fund into the Sanitary Sewer Assessment Fund to provide for the City's share in the cost of sanitation improvements in relation to the Hilock/Lewis Roads Assessment Sewer Project;
 
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a contract for the aforementioned construction services, and to be authorized to expend sufficient funds for the payment of construction inspection and prevailing wage coordination services associated with the subject project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities in that it is immediately necessary for this Council to authorize the Director of Public Utilities to execute a contract with Darby Creek Excavating, Inc., for the construction of the Hilock/Lewis Roads Assessment Sewer Project, that is urgently needed to replace failing on-site sewer systems that serve the residential properties surrounding this project; to authorize the appropriation and expenditure of funds; for the preservation of the public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the construction contract stated herein.

Section 2.  That the City Auditor is hereby authorized and directed to appropriate and transfer $581,578.27 for the Hilock/Lewis Roads Assessment Sewer Project from the Sanitary Sewer Bond Fund into the Sanitary Sewer Assessment Fund, Div. 60-05, as follows:

Section 3.  That the City Auditor is hereby authorized to appropriate a total of $967,664.54 for the Hilock/Lewis Roads Assessment Sewer Project within Sanitary Sewer Assessment Fund No. 662 | Div. 60-05 | Subfund No. 582 | Object Level Three No. 6630 | OCA Code No. 662582 | Amount: $967,664.54.
 
Section 4.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project account by monies from more than one source.
 
Section 5.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 6.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contracts or contract modifications associated with this ordinance.
 
Section 7.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Hilock/Lewis Roads Assessment Sewer Project; with the lowest, best, responsive and responsible bidder, Darby Creek Excavating, Inc., 6790 Brooks Miller Rd., Circleville, Ohio 43113, in the amount of $826.223.52 in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage; to pay interest on the note for the residents share to a maximum of $17,507.49; to obtain the necessary construction inspection and prevailing wage coordination services and to pay up to a maximum of $123,933.53 thereof.
 
Section 8.  That for the purpose of paying the cost of the construction contract, together with interest on the note for the residents share, as well as inspection and prevailing wage coordination services for the improvements, the expenditure of $967,664.54, or as much thereof as may be needed, is hereby authorized from Division of Sewerage and Drainage as follows:
