Explanation
 
1.  BACKGROUND:  This legislation authorizes the Director of Public Utilities to enter into a construction contract with Tata Excavating, Inc., in the amount of $294,812.82; to encumber funds with the Transportation Division for inspection, testing and prevailing wage coordination services in the amount of $45,221.92, for a grand total of $340,034.74; and to amend the 2005 Capital Improvements Budget; all in connection with the Mock Road Stormwater System Improvements.
 
2.  CONSTRUCTION CONTRACT AWARD:  The Director of Public Utilities publicly opened seven bids on February 22, 2006.  The lowest and best bid was from Tata Excavating; 31-0717926; $294,812.82.  The bids are listed below:

3.  EMERGENCY DESIGNATION:  The Division of Sewerage and Drainage is requesting City Council to designate this ordinance an emergency measure in order to allow for the immediate commencement of these urgently needed stormwater infrastructure improvements during the upcoming construction season.  
 
4.  FISCAL IMPACT:  The Division of Sewerage and Drainage is requesting an amendment to the 2005 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure.  There is sufficient cash for the expenditures associated with this project.

To authorize the Director of Public Utilities to execute a construction contract with Tata Excavating; to provide for payment of inspection, material testing and related services to the Transportation Division; for the Mock Road Stormwater System Improvements; to authorize an amendment to the 2005 Capital Improvements Budget; for the Division of Sewerage and Drainage; to authorize the expenditure of $340,034.74 within the Storm Sewer Bond Fund; and to declare an emergency. WHEREAS, seven bid proposals were received and publicly opened in the offices of the Director of Public Utilities on February 22, 2006,  for the construction of the Mock Road Stormwater System Improvements; and
 
WHEREAS, it is necessary to authorize the Director of the Department of Public Utilities to award and execute a construction contract and to encumber and expend funds to provide for payment of inspection, testing and prevailing wage coordination services costs associated with the Mock Road Stormwater System Improvements; and
 
WHEREAS, significant flooding and other stormwater problems have been identified through customer complaints for the area covered by this project; and
 
WHEREAS, it is necessary to authorize an amendment to the 2005 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, in that it is immediately necessary to authorize the Director of Public Utilities to enter into a contract for construction services for the Mock Road Stormwater System Improvements, in an emergency manner in order to mitigate the significant flooding and other stormwater problems; for the immediate preservation of the public health, peace, property and safety; now therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for construction of the Mock Road Stormwater System Improvements with the lowest and best bidder, Tata Excavating, 1797 Williams Road; Columbus, Ohio 43207; in the amount of $294,812.82 in accordance with the terms and conditions of the contract on file in the Office of the Division of Sewerage and Drainage; and to obtain the necessary testing and prevailing wage coordination services from the Transportation Division; and to pay up to a maximum amount of $45,221.92, for a grand total of $340,034.74.
 
SECTION 2.  That the said construction company shall conduct the work to the satisfaction of the Directors of Public Utilities and Public Service and the Administrators of the Divisions of Sewerage and Drainage, Water, and Transportation.
 
SECTION 3.  That for the purpose of paying the cost of the construction contract, the cost of inspection, testing and prevailing wage coordination services, the following expenditure, or as much thereof as may be needed is hereby authorized as follows:  Division 60-15, Storm Sewer Bond Fund No. 685, Project 610714, Object Level Three 6621, OCA Code 685714, Amount $340,034.74.
 
SECTION 4.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, to provide sufficient budget authority for the execution of the construction contract stated in Sections 4 and 5 herein.

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
