Explanation
 
This ordinance authorizes the Public Service Director to enter into a contract for the Transportation Division for crack sealing of city streets.  The Transportation Division is responsible for maintaining the City's roadway system through a viable renovation program.  A crack seal program is needed to prevent premature deterioration of the City's roadways.  The contract will consist of placing crack seal over pavement cracks on 290 of our arterial and residential streets.  The Transportation Division will perform inspection services at a cost of $30,644.00.  This project was bid in compliance with the City Code and advertised in the City Bulletin.  Formal competitive bids were received and tabulated on May 6, 2004 by the Transportation Division as follows:

Award of the contract is recommended to American Pavements, Incorporated, contract compliance number 31-1409601 (expires January 29, 2006) as the lowest, best, most responsive, and most responsible bidder.
Fiscal Impact:  The Transportation Division budgeted $15.5 million for street resurfacing in the 2004 Capital Improvements Budget.  Street crack sealing is part of the resurfacing budget and this ordinance will authorize $413,688.86 for this purpose.  
 
Emergency action is requested to allow this project to proceed and be completed this construction season.
 
 
 
Title
 
To authorize the Public Service Director to enter into a contract with American Pavements, Incorporated, for the Crack Seal - 2004 project for the Transportation Division; to authorize the expenditure of $413,688.86 from the 1995, 1999 Voted Streets and Highways Fund, and to declare an emergency. ($413,688.86)
 
 
 
Body
 
WHEREAS, the Transportation Division is responsible for maintaining the City's roadways; and
 
WHEREAS, crack seal is needed to prevent early deterioration of the City's roadway system; and
 
WHEREAS, formal competitive bids were received and tabulated on May 6, 2004 by the Transportation Division for the Crack Seal - 2004 project and a satisfactory low bid was received; and
 
WHEREAS, the Transportation Division recommends acceptance of the lowest, best, most responsive and responsible bid submitted by American Pavements, Inc., and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that this contract should be immediately awarded so that the work may proceed without delay and be completed this construction season, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Public Service Director be and hereby is authorized to enter into a contract with American Pavements, Incorporated, 7475 Montgomery Drive, Plain City, Ohio 43064 for the Crack Seal - 2004 project in accordance with the applicable specifications and plans on file in the office of the Transportation Administrator, which are hereby approved, and to provide for construction inspection services.
 
SECTION 2.  That for the purpose of paying the cost of the contract and inspection the sum of $413,688.86, or so much thereof as may be needed, be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6621, OCA Code 644385 and Project 530282.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
