APPLICANT:  Columbus Metropolitan Library; c/o Jay Boone, Arch.; Moody Nolan Inc.; 300 Spruce Street, Suite 300; Columbus, OH 43215.
 
PROPOSED USE:  Parking lot.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0-1) on July 14, 2005.
 
SOUTH LINDEN AREA COMMISSION:  Approval.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested CPD, Commercial Planned Development District will allow library parking with use restrictions and development standards that are consistent with the established zoning and development patterns of the area.

To rezone1525 EAST KOHR PLACE (43211), being 0.41± acres located on the south side of East Kohr Place 136± feet west of Cleveland Avenue, From:  R-3, Residential District, To:  CPD, Commercial Planned Development District and to declare an emergency. (Rezoning # Z05-033)
 
 
 
Body
 
WHEREAS, application #Z05-033 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.41± acres from the R-3, Residential District to CPD, Commercial Planned Development District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance so that the applicant can fulfill contract deadlines with the property owners for the immediate preservation of the public peace, property, health and safety; and
 
WHEREAS, the South Linden Area Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested CPD, Commercial Planned Development District would permit continuation of the existing commercial development which is consistent with the zoning and land use patterns of the area, now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1525 EAST KOHR PLACE (43211), being 0.41± acres located on the south side of East Kohr Place 136± feet west of Cleveland Avenue, and being more particularly described as follows:

      Situated in the State of Ohio, County of Franklin, City of Columbus, being all of Lots 44 through 47, Mapleview subdivision, Plat Book 7, Pages 414 and 415, Recorder's Office, Franklin County, Ohio, and being more particularly described as follows:
 
      Beginning at the northeasterly corner of Lot 44 at the intersection of the southerly right-of-way line of Kohr Place with the westerly right-of-way line of the 16-foot wide alley west of Cleveland Avenue;
 
      Thence South 25°19'56" West, along said westerly right-of-way line, a distance of 117.41 feet to the intersection of the northerly right-of-way line of another 16-foot wide alley;
 
      Thence North 86°29'02" West, along said northerly right-of-way line, a distance of 143.69 feet to the southwesterly corner of Lot 47;
 
      Thence North 3°30'58" East, along the westerly line of Lot 47, a distance of 109.00 feet to the northwesterly corner of same and in the southerly right-of-way line of Kohr Place;

SECTION 2.  That a Height District of thirty-five (35) feet is hereby established on the CPD, Commercial Planned Development District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved CPD, Commercial Planned Development District and Application among the records of the Building Services Division as required by Section 3311.12 of the Columbus City Codes; said plans being titled, "LANDSCAPE PLAN" and "SITE PLAN" all signed by Curtis J. 1.      INTRODUCTION:  The site is part of the Linden Branch Library parking lot development and is bound by Kohr Place on the north, Barbee W. Durham Place on the east, a 16' alley on the south and the eastern edge of lot 48 along Kohr Place.  The rezoning will permit parking and incorporate the City of Columbus standards for parking lot screening and plantings.
 
2.      PERMITTED USES:  Parking for development along the west side of Cleveland Avenue.
 
3.      DEVELOPMENT STANDARDS:  Unless otherwise indicated in this text or the Site Plan, the development standards for C-4, as contained in Chapter 3355 of the Columbus City Code shall apply.
 
      A.      Density, lot and/or setback commitments
 
1.      The parking lot setback from Kohr Place shall be 10'-0".
 
2.      The parking lot setback from Barbee W. Durham shall be 18'-0" to centerline.
 
3.      The parking lot setback from 16' alley shall be 10'-0" to the centerline.
 
4.      The parking lot setback from Lot 48 shall be 15'-0".
 
B.      Access, Loading, Parking and/or Other Traffic Related Commitments
 
1.      All circulation, curb cuts and access points shall be subject to the approval of the Division of Transportation.
 
2.      The subject site shall have one access point from Barbee W. Durham Place, directly across from the existing Linden Branch Library.
 
3.      38 parking spaces are planned.
 
C.      Buffering, Landscaping, Open Space, and/or Screening Commitments.
 
1.      The landscaping screening along Lot 48, the 16' alley and Kohr Place shall comply with Section 3372.607.
 
2.      All trees and landscaping shall be well maintained.  Dead items shall be replaced within six months or the next planting season, whichever occurs first.
 
3.      All trees meet the following minimum size at the time of planting:
Shade trees 2 inch caliper; Ornamental trees 1 ½ inch caliper; Evergreen trees 5 feet in height.  Tree caliper is measured six (6) inches from the ground.
 
4.      The intended species of trees to be planted are as follows:

E.      Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
1.      All external lighting shall be cut-off fixtures (down-lighting) and shall be designed to prevent offsite spillage.
 
2.      All external outdoor lighting fixtures to be used shall be from the same or similar manufacturers type to insure compatibility.
 
3.      Light poles in the parking lot shall not exceed 20 feet in height (to match the existing Linden Library parking lot light poles).
 
4.      The average horizontal illumination level on the ground shall not exceed two and one-half (2 ½) foot candles.  The light level along the property line adjacent to a residentially zoned or used property shall not exceed an average intensity of one-half (1/2) foot candle.
 
F.      Graphics and/or Signage Commitments
 
1.      All graphics and signage shall comply with the Graphics Code, Article 15, Title 33 of the Columbus City Code as it applies to the CPD and any variance to those requirements will be submitted to the Columbus Graphics Commission for consideration.
 
G.      Miscellaneous Commitments.
 
1.      The site shall be developed in substantial accordance with the Site Plan submitted herewith.  The Zoning Site Plan may be slightly adjusted to reflect engineering, topographical, or other site data developed at the time of the development and when engineering and architectural drawings are completed.  Any slight adjustments to the Zoning Site Plan shall be subject to the review and approval by the Director of the Department of Development, or his designee, upon submission of the appropriate data regarding the proposed adjustment.
 
A.      CPD Criteria
 
1.      Natural Environment
 
The site is developed adjacent to the Linden Branch Library which is zoned C-4.
 
2.      Existing Land Use

3.      Proposed Use:  
 
Commercial parking for adjacent Linden Branch Library
 
4.      Transportation and Circulation
 
Access will be from an existing alley system (Barbee W. Durham Place).
 
5.      Visual Form of the Environment
 
The visual form of the development will be established at the time of construction and is represented on the attached site plan.
 
6.      View and Visibility
 
View and visibility of the development shall be determined at the time of construction and the plantings and fencing should enhance and compliment the Library and neighborhood.
 
7.      Emissions
 
No adverse emissions are expected from this development.
 
B.      Variances
 
The parking setbacks are as follows:
 
1.      The parking lot setback from Kohr Place shall be 10'-0".
 
2.      The parking lot setback from Barbee W. Durham shall be 18'-0" to centerline.
 
3.      The parking lot setback from 16' alley shall be 10'-0" to the centerline.
 
4.      The parking lot setback from Lot 48 shall be 15'-0".
 
The Subject Site shall be developed in accordance with the site plan. The site plan may be slightly adjusted to reflect engineering, topographical or other site data developed at the time of development and engineering plans are completed.  Any slight adjustment to the plan shall be reviewed and may be approved by the Director of the Department of Development or his designee upon submission of the appropriate data regarding the proposed adjustment.
 
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
