1. Background
The purpose of this legislation is to repeal Ordinance 0020-2024, passed on January 22, 2024. Ordinance 0020-2024 was written to extinguish a 2.538 acre portion of right-of-way located in Genoa Park and transfer the asset to The City of Columbus, Recreation and Parks Department. It has been determined that incorrect wording was used in the ordinance. The Department of Public Service requests that Ordinance 0020-2024 be repealed. New Legislation will be written to correctly state the manner in which the transfer is to take place.

Emergency action is requested in order to repeal this ordinance so a new ordinance can be written and submitted, so the project can move forward as intended.

WHEREAS, Ordinance 0020-2024, passed on January 22, 2024, was written to extinguish a 2.538 acre portion of right-of-way located in Genoa Park and transfer the asset to The City of Columbus, Recreation and Parks Department; and
WHEREAS, it has been determined by The Department of Public that incorrect wording was used in the ordinance; and
WHEREAS, it is necessary that Ordinance 0020-2024 be repealed, so that new Legislation can be written to correctly state the manner in which the transfer is to take place; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize these actions so that a new ordinance can be written and submitted for consideration in order for the project to proceed as scheduled, all for the immediate preservation of the public health, peace, property, safety and welfare; and now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Ordinance Number 0020-2024, passed on January 22, 2024 is hereby repealed in its entirety.
SECTION 2. That new Legislation will be written to correctly state the manner in which the transfer is to take place.
SECTION 3. That for the reasons stated in the preamble thereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves not vetoes the same.
