Explanation
 
1.      BACKGROUND:
 
A.  Need.  This legislation authorizes the Director of Public Utilities to enter into a professional engineering services agreement with Burgess & Niple, Inc. for the First Avenue Inflow Redirection project for the Division of Sewerage and Drainage.  Professional engineering services are required for this project to redirect all public sources of inflow from the combined sewers tributary to the First Avenue regulator as recommended by the City's Wet Weather Management Plan.  Also included in this project is the condition assessment of these combined sewers and manholes within the project area, and design services for the rehabilitation or replacement of these sewers and manholes as necessary.
 
General professional services to be performed under this contract include cleaning and televising the existing combined sewers, performing manhole inspections and evaluations, investigating the need for easements, performing field surveying, preparing a Design Report to document evaluations and recommendations, generating detailed construction plans and specifications, preparing site-specific maintenance of traffic plans, supplying all construction documents required for bidding, performing engineering services during construction, and preparing as-built drawings at the completion of the project.  Projected beginning and ending dates for the professional engineering services on CIP 708 are July 2008 and April 2012, respectively.  There is no phasing on this project.
 
B.    Procurement Information:  Burgess & Niple, Inc., was selected in accordance with the procedures set forth in Columbus City Code, Section 329.13.   Requests for Cost Proposals (RFP's) were sent to seven firms having the experience necessary to complete the project; Burgess & Niple, Inc., FMSM, Inc., Chester Engineers, R.D. Zande & Associates, Civil & Environmental Consultants, Inc., Pomeroy & Associates, and Prime Engineering & Architecture, Inc.  All seven consultants submitted RFP's on 11/16/2007.  Upon review of the technical proposals, the bidders were ranked using criteria specified in City Code, and more specifically: proposal quality/feasibility, competence to perform required work, project schedule, and location of the workforce.  Based upon these criteria, Burgess & Niple, Inc., was selected as the highest-ranked bidder.

D.       Emergency Designation:  Emergency designation is not requested.
 
 
2.      FISCAL IMPACT:
 
Sufficient monies and authority are already present to cover the necessary expenditure.  This legislation will authorize an expenditure of $525,597.33 from the Sanitary Sewer Revenue Bonds Fund upon passage of this ordinance.

To authorize the Director of Public Utilities to enter into a professional engineering services agreement with Burgess & Niple, Inc., for the First Avenue Inflow Redirection project; and to authorize the expenditure of $525,597.33 within the Sanitary Sewer Revenue Bonds Fund for the Division of Sewerage and Drainage. ($525,597.33).

WHEREAS, the procurement was conducted in accordance with the Request For Proposals (RFP) process set forth in Section 329.14, Columbus City Codes, 1959: seven proposals were received and the Division's Evaluation Committee selected Burgess & Niple, Inc. from among the seven firms; and
 
WHEREAS, it is necessary for the City Council to authorize the expenditure of funds from the Sanitary Sewer Revenue Bonds Fund; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into an agreement for professional engineering services with Burgess & Niple, Inc. in connection with the First Avenue Inflow Redirection project, pursuant to the successful completion of this vital wastewater treatment plant infrastructure, at the earliest practicable date; Now, Therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the Director of Public Utilities be, and hereby is, authorized to enter into an agreement for professional engineering services with Burgess & Niple, Inc., 5085 Reed Rd., Columbus, Ohio 43220, in connection with the First Avenue Inflow Redirection project, in accordance with the terms and conditions as shown in the agreement on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That for the purpose of paying the cost of the professional engineering services contract, the expenditure of $525,597.33, or as much thereof as may be needed, is hereby authorized from the Sanitary Sewer Revenue Bonds Fund, Fund No. 665 | Division 60-05 | Project No. 650708 | OCA Code 665708 | Object Level Three 6676.
      
Section 3.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 4.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 5.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 6.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
