Explanation
1. BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into a construction contract with Kokosing Construction Company, Inc. in connection with the Southerly Wastewater Treatment Plant Effluent Disinfection Improvements project for the Division of Sewerage and Drainage. This legislation also authorizes the expenditure of funds needed for those contracts from the Ohio Water Pollution Control Loan Fund.
 
This project is providing for improvements to the plant's effluent disinfection facilities in two phases of project construction, primarily to improve process capacity, efficiency and safety.  
The proposed contract with Kokosing Construction Company is for Contract S69 - Chlorine Contact Tank No. 4, and is the second phase of project construction.  This contract will construct the second new chlorine contact tank under this project, and the associated disinfection and dechlorination process equipment.
 
The contract was advertised in the City Bulletin, and bids were received on April 20, 2005, as follows:
1. Kokosing Construction Company, Inc.|Majority Firm|$3,573,058.65
2. C. J. Mahan Construction Company, LLC|Majority Firm|$3,670,590.00
3. Dugan & Meyers Construction Company|Majority Firm|$3,780,000.00
4. Crace Construction Company|Majority Firm|$3,946,051.00
The Engineer's construction cost estimate was $4,500,000.00
 
Award is recommended to the lowest and best bidder.
 
2. EMERGENCY DESIGNATION:
Emergency designation is requested for this legislation, in order to allow award of the construction contract immediately, and avoid the possibility of claimed escalation in material costs, which the City understands is being contemplated by some suppliers, given recent, dramatic escalation in fuel and associated prices.

To authorize the Director of Public Utilities to enter into a construction contract with Kokosing Construction Company, Inc. in connection with the Southerly Wastewater Treatment Plant Effluent Disinfection Improvements, for the Division of Sewerage and Drainage; to authorize the expenditure of $3,573,058.65 from the Ohio Water Polllution Control Loan Fund; and to declare an emergency.  ($3,573,058.65)
 
Body
WHEREAS, four competitive bids for construction of the Southerly Wastewater Treatment Plant Effluent Disinfection Improvements, Contract S69 - Chlorine Contact Tank No. 4, were received and opened April 20, 2005 in the offices of the Director of Public Utilities; and
 
WHEREAS, the Ohio Water Development Authority approved a loan to the City of Columbus on July 28, 2005, in the amount of $4,762,677.11, identified as Loan Number 4361; and
 
WHEREAS, The Division of Sewerage and Drainage engineering personnel have determined it necessary to enter a construction contract with Kokosing Construction Company, Inc. in order to provide for construction of Contract S69 - Chlorine Contact Tank No. 4, Contract S69, of the Southerly Wastewater Treatment Plant, Effluent Disinfection Improvements Project; and
 
WHEREAS, it is immediately necessary to appropriate the proceeds from the aforementioned loan; to authorize the expenditure of funds required to award the subject contract; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary for this Council to authorize the Director of Public Utilities to expedite the award of the construction contract with Kokosing Construction Company, Inc. in connection with the Effluent Disinfection Improvements project at the Southerly Wastewater Treatment Plant, which is required to give Notice To Proceed to the Contractor before the bid proposals expire; for the immediate preservation of the public health, peace, property, and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the proceeds from the Ohio Water Development Authority Loan No. 4361, for the Southerly Wastewater Treatment Plant, Effluent Disinfection Improvements Project; and funds from the unappropriated monies in Fund 666, the amount of $4,762,677.11 that includes funding for the cost of construction and construction administration and inspection services, is hereby appropriated to the Division of Sewerage and Drainage| Division 60-05| Fund No. 666| Object Level Three 6624| OCA Code 666355| Project Account 650355.
 
Section 2.  That the Director of Public Utilities be, and hereby is, authorized to award and execute a contract for the construction of the Southerly Wastewater Treatment Plant, Effluent Disinfection Improvements Project, with the lowest, best, responsive and responsible bidder, Kokosing Construction Company, Inc., 886 McKinley Avenue, Columbus, Ohio 43222, in the amount of $3,573,058.65 in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage.
 
Section 3.  That for the purpose of paying the cost of construction contract, the expenditure of $3,573,058.65, or as much thereof as may be needed, is hereby authorized from the Ohio Water Pollution Control Loan Fund No. 666| Division 60-05| Project 650355| OCA Code 666355| Object Level 3 No. 6624| $3,573,058.65.
 
Section 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
