Council Variance Application: CV25-092

 

APPLICANT:  Diane Johnson; 2744 Fairwood Avenue; Columbus, OH 43207.

 

PROPOSED USE:  Manufactured home.

 

FAR SOUTH COLUMBUS AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The site consists of an undeveloped parcel in the R-2, Residential District. A Council variance is required because the R-2 district only allows single-unit dwellings as a primary residential use, while the applicant proposes to construct a manufactured home on the property. Staff supports the request as it is consistent with both the Tri-South Neighborhood Plan’s (2004) recommendation of “Single-Family Residential,” and Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018), and not that the proposed use will not add an incompatible use to the area.

To grant a Variance from the provisions of Section 3332.033, R-2 residential district, of the Columbus City Codes; for the property located at 2734 FAIRWOOD AVE. (43207), to allow a manufactured home in the R-2, Residential District (Council Variance #CV25-092).

 

Body

 

WHEREAS, by application #CV25-092, the owner of property at 2734 FAIRWOOD AVE. (43207), is requesting a Council variance to allow a manufactured home in the R-2, Residential District; and

 

WHEREAS, Section 3332.033, R-2 residential district, allows a single-unit dwelling as the primary residential use, while the applicant proposes to construct a manufactured home on the site; and

 

WHEREAS, the Far South Columbus Area Commission recommends approval; and

 

WHEREAS, the City Departments recommend approval because the requested use is consistent with both the Tri-South Neighborhood Plan’s and C2P2 Design Guidelines, and will not introduce an incompatible use to the area; and

 

WHEREAS, said ordinance requires separate submission for all applicable permits and Certificate of Occupancy for the proposed manufactured home; and

 

WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and

 

WHEREAS, the granting of said variance will not impair an adequate supply of light and air to the adjacent property, unreasonably increase the congestion of public streets, increase the danger of fires, endanger the public safety, unreasonably diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety, comfort, morals or welfare of the inhabitants of the City of Columbus; and

 

WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owner of the property located at 2734 FAIRWOOD AVE. (43207), in using said property as desired; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1. That a variance from the provisions of Section 3332.033, R-2, residential district, of the Columbus City Codes; is hereby granted for the property located at 2734 FAIRWOOD AVE. (43207), insofar as said section prohibits a manufactured home in the R-2, Residential District; said property being more particularly described as follows:

 

2734 FAIRWOOD AVE. (43207), being 0.28± acres located at the southeast corner of Fairwood Avenue and Dewberry Road, and being more particularly described as follows:

 

Situated in the City of Columbus, County of Franklin. State of Ohio, and being a 0.276 acre tract of land out of Lot 123 in Opportunity Farms, a subdivision of record in Plat Book 15, Page 28, as conveyed to Diane Johnson in Official Record 29358BC8 and being more particularly described as:

Commencing, for reference, at a ¾-inch iron pin found at the southwesterly corner of said Lot 123, the northwesterly comer of Lot 124 in said subdivision and being in the easterly right-of-way line of Fairwood Avenue (50’);

 

Thence, North 00°04'05” East, with the westerly line of said Lot 123 a distance of 62.90 feet to an iron pin set at the TRUE PLACE OF BEGINNING;

 

Thence, from said TRUE PLACE OF BEGINNING, North 00°04'05 East, with the westerly line of said Lot 123, a distance of 84.68 feet to an iron pin set at the northwesterly corner of Lot 123, the same being at the intersection of the easterly right-of-way line of said Fairwood Avenue with the southerly right-of-way line of Dewberry Avenue (50’ - undeveloped);

 

Thence, South 89°41'29” East, with the northerly line of said Lot 123, a distance of 142.08 feet to tan iron pin set at the northeasterly corner of said Lot 123, also being the point of intersection of said southerly right-of-way line with the westerly right-of-way line of 16’ alley;

 

Thence, South 0°04'05” West, with the easterly line of said Lot 123 and with said alley right-of-way line, a distance of 84.68 feet to an iron pin set;

 

Thence, South 89°41'29 East, crossing said Lot 123, a distance of 142.08 feet to the TRUE PLACE OF BEGINNING.

 

Containing 0.276 acres of land, more or less, out of Auditors Parcel #010-113753.

SECTION 2.  That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a manufactured home, or those uses allowed in the R-2, Residential District.

 

SECTION 3.  That this ordinance is further conditioned upon the applicant obtaining all applicable permits and a Certificate of Occupancy for the proposed manufactured home.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
