Explanation
BACKGROUND:      
 
Need: The purchase of fifty (50) semi-automatic pistols Division of Police for new police recruit class beginning in December 2005.
 
Bid Information: A formal bid, Solicitation No. SA001808 was opened on November 10, 2005.
Three suppliers submitted bids for semi-automatic pistols; Vance Outdoors, Inc. was the lowest, responsive, responsible bidder. Due to insufficient funds, the Division of Police has requested the number of semi-automatic pistols to be lowered from the original request of 100 pistols to 50 pistols. Ordnance personnel have indicated that 50 pistols will be sufficient to outfit the upcoming police recruit class. The Division of Police is requesting cancellation of the original bid, SA001808 and for all bids to be considered informally since the original request has been modified and due to insufficient time to rebid with the new Police recruit class beginning in December 2005. The Division of Police has contacted the low bidder, Vance Outdoors, Inc. and the supplier is willing to hold pricing for the reduced number of pistols.

This company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.
 
Emergency Designation: Emergency legislation is requested so as to receive semi-automatic pistols on a timely basis and before year-end closing.
 
FISCAL IMPACT:
 
Funding for this purchase is contingent on the Department of Finance and Management's year-end citywide transfer, ordinance #2042-2005.

Body
 
WHEREAS, the Division of Police needs to purchase semi-automatic pistols for its new recruit class; and
 
WHEREAS, formal bid SA001808 for the purchase of semi-automatic pistols for the Division of Police, Department of Public Safety was received by the Purchasing Office on November 10, 2005; and
 
WHEREAS, due to insufficient funds, the Division of Police has requested the number of semi-automatic pistols to be lowered from the original request of 100 pistols to 50 pistols; and
 
WHEREAS, the Division of Police is requesting cancellation of the original bid, SA001808 and for all bids to be considered informally since the original request has been modified and due to insufficient time to rebid; and
 
WHEREAS, it is in the best interest of the City that competitive bidding be waived; and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Police, Department of Public Safety, in that it is immediately necessary to semi-automatic pistols for the new Police recruit class for the Division for the preservation of public health, peace, property, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Finance and Management Director be and is hereby authorized and directed to enter into contract for the purchase of semi-automatic pistols with Vance Outdoors, Inc. in the amount of $33,299.00 for the Division of Police.
 
Section 2. That in accordance with Section 329.27 of Columbus City Codes, this Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.06 of the Columbus City Codes to permit the aforementioned purchase.
 
Section 3. That the expenditure of $33,299.00, or so much thereof as may be needed, be and same is hereby authorized as follows:

Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
