Explanation
The City is the owner of a building located at 475 Elwood Avenue that was formerly leased until May 31, 2007 by the Child Development Council of Franklin County ("CDCFC") for a Head Start program. Since that time, the federal grant for the administration of Head Start for this area has been awarded to the Columbus Urban League. The Columbus Urban League now desires to lease 475 Elwood Avenue for use as a Head Start facility. The following legislation authorizes the Director of the Department of Finance and Management to execute those documents necessary to enter into a lease agreement with the Columbus Urban League.
Fiscal Impact: The City of Columbus will receive $15,972.00 for the one year term of the lease agreement, with proceeds made payable to the City Treasurer for deposit in the General Fund.
Emergency Justification: Federal approval of the the Columbus Urban League grant for the Head Start program was administratively delayed until just recently. The Columbus Urban League is anxious to begin serving the children of this area with a Head Start program as soon as possible.
Title
To authorize the Director of the Department of Finance and Management to enter into a one year lease agreement with the Columbus Urban League for that City-owned property commonly known as 475 Elwood Avenue, Columbus, Ohio and to declare an emergency.
Body
WHEREAS, the City of Columbus, Ohio owns certain real property commonly known as 475 Elwood Avenue; and,
WHEREAS, the City of Columbus desires to enter into a lease agreement with the Columbus Urban League for the real property commonly known as 475 Elwood Avenue in order open a Head Start program; and,
WHEREAS, the Columbus Urban League has agreed to the lease terms and is eager to begin the Head Start program as soon as possible; and,
WHEREAS, an emergency exists in the daily operation of the City of Columbus, in that it is immediately necessary to authorize the Director of the Department of Finance and Management to enter into a lease agreement with the Columbus Urban League for the rental of real property located at 475 Elwood Avenue, and for the immediate preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Department of Finance and Management be, and hereby is, authorized to execute those documents, as approved by the Department of Law, Division of Real Estate, necessary to enter into a one (1) year lease agreement for the rental of real property located at 475 Elwood by and between the City of Columbus (Lessor) and the Columbus Urban League (Lessee) at an annual rental rate of $5.50 per square foot, or $15,972 per year.
Section 2. That the terms and conditions of this lease shall be in a form approved by the City Attorney's Office and shall include the following:
a) The lease shall have an initial term of one (1) year commencing November 1, 2007 and terminating on October 31, 2008.
b) The lease will contain two one-year renewal option(s) and a Landlord termination provision.
c) Such other terms and conditions as are required and/or approved by the City Attorney's Office.
Section 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
