Explanation
Background: This ordinance will enable the Director of Recreation and Parks to enter into a contract with Class Acts Columbus, Inc., for professional and fiscal services to Music in the Air and the Office of Special Events for Festival Latino to be held June 20-21, 2008; Jazz & Rib Fest to be held July 25, 26 and 27, 2008 and Rhythm on the River/Family Fun Flicks to be held August 1, 8, 15, 22 and 29, 2008. Class Acts Columbus, Inc. will provide professional services to Music in the Air and the Office of Special Events as fiscal agent and production assistance for Festival Latino, Jazz & Rib Fest, Rhythm on the River/Family Fun Flicks and other events as needed. As fiscal agent, Class Acts Columbus Inc. will process artists' contracts and pay all deposits and artists' fees associated with these contracts. Class Acts Columbus Inc. will collect all festival vendor fees and beverage receipts, and pay event expenses from invoices as authorized and directed by CRPD. Class Acts Columbus Inc. will maintain financial records pertaining to all transactions. Class Acts Columbus, Inc. will receive $5,500 and 4% of the artists' contract fees as payment for these services. Total payment to Class Acts Columbus, Inc. cannot exceed $14,519. Payment will be made to Class Acts Columbus, Inc. upon receipt of proof of payment and invoice for services rendered.
Due to the unique nature of the services provided, the Department is requesting the waiver of the competitive bidding provisions of the Columbus City Code to enter into a contract with Class Acts Columbus, Inc.
The Federal ID Number for Class Acts Columbus, Inc., is 31-1340678 and they are contract compliant through 04/06/09.
Emergency action is requested in order to obtain commitments from entertainers, secure major programmatic elements and process contracts for performances begininning in June 2008.
Fiscal Impact: $240,000.00 is required to meet the financial obligation of this contract. $240,000.00 was spent in 2007 for these services.

WHEREAS, it is in the best interest of the City of Columbus to waive the formal bidding provisions of the Columbus City Code 329.06(b) and contract with Class Acts Columbus, Inc., to provide professional and fiscal services to Music in the Air and the Office of Special Events for Festival Latino to be held June 20-21, 2008; Jazz & Rib Fest to be held July 25, 26 and 27, 2008 and Rhythm on the River/Family Fun Flicks to be held August 1, 8, 15, 22 and 29, 2008; and
WHEREAS, an emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to enter into said contract in order to obtain commitments from artists, secure major programmatic elements and process contracts for performances by June 2008; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That this Council finds it in the best interest of the City of Columbus to waive the provisions of the Columbus City Code to Music in the Air and the Office of Special Events for Festival Latino to be held June 20-21, 2008; Jazz & Rib Fest to be held July 25, 26 and 27, 2008 and Rhythm on the River/Family Fun Flicks to be held August 1, 8, 15, 22 and 29, 2008, and does hereby waive provisions of Section 329.06(b) of the Columbus City Codes.
SECTION 2. That the Director of Recreation and Parks be and he is hereby authorized and directed to enter into contract with Class Acts Columbus, Inc., to provide professional and fiscal services to to Music in the Air and the Office of Special Events for Festival Latino to be held June 20-21, 2008; Jazz & Rib Fest to be held July 25, 26 and 27, 2008 and Rhythm on the River/Family Fun Flicks to be held August 1, 8, 15, 22 and 29, 2008.
SECTION 3. That the expenditure of $240,000.00, or so much thereof as may be necessary, be and is hereby authorized from Department No. 51-01,as follows, to pay the cost thereof:

SECTION 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
