Explanation
1. BACKGROUND: To authorize consent and propose cooperation with Franklin County, Ohio for the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project and to authorize Franklin County to acquire right-of-way located within Columbus's corporate jurisdiction on behalf of Columbus and in Franklin County's name, as necessary for the project. Upon completion of the project, Franklin County shall quit claim its interest in the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus. This is a Franklin County project, with federal funding and oversight from the Ohio Department of Transportation (ODOT).
The purpose of this project is to reconstruct the intersection of Brice Road and Winchester Pike.
Because the project limits extend into the City of Columbus, ODOT has requested that the City of Columbus formally authorize consent through legislation for Franklin County to perform the work within Columbus's corporate jurisdiction.
Construction is estimated to begin in May 2015, and conclude in October 2015.
2. FISCAL IMPACT: The estimated project cost $4,000,000, with funding provided by FCEO and ODOT. No funding from Columbus is required for this project.
3. EMERGENCY DESIGNATION: Emergency action is requested to provide this consent to Franklin County so the agency may maintain its project schedule.

WHEREAS, Franklin County has identified the need for the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project; and
WHEREAS, a part of the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project is within the Columbus corporate jurisdiction; and
WHEREAS, the City of Columbus grants consent and proposes cooperation with Franklin County, Ohio for the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project; and
WHEREAS, the City of Columbus authorizes Franklin County to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus; and
WHEREAS, upon completion of the project, Franklin County shall quit claim its interest in the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to meet the project schedule for the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project for the safety of the travelling public thereby preserving the public health, peace, property, safety and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. The City hereby grants consent to and proposes cooperation with Franklin County, Ohio for the development and construction of the FRA-TR229-1.89, (Winchester Pike at Bixby Rd. - Brice Rd) (PID 82404) roadway improvement project.
SECTION 2. The City hereby authorizes Franklin County to acquire right-of-way located in the City of Columbus jurisdiction on behalf of Columbus, and in Franklin County's name, as necessary for the project, and for Franklin County to quit claim its interest in the right-of-way located in the City of Columbus's corporate jurisdiction to the City of Columbus after construction has been completed.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither vetoes or approves the same.
