Explanation
Background: Approval of ordinance 2807- 97 on November 24, 1997, authorized the Franklin County Municipal Court Clerk to enter into a contract with Maximus, Inc. formerly known as Crawford Consulting, Inc. for the installation of CourtView 2000, the Franklin County Municipal Court Clerk case management system. The proprietary ownership by Maximus. Inc. of the CourtView 2000 software is addressed in contract number 18848. The software and all copies are proprietary to Maximus.
The Franklin County Municipal Court Clerk negotiated a new maintenance and support contract with Maximus, Inc., the sole source provider of said services for the Municipal Court Clerk case management system. Due to the timeliness and complexity of the negotiations, the contract was not negotiated before the last council meeting before the summer recess. Therefore, on August 8, 2007 a Mayor's emergency was declared authorizing contract # EA006734 for the first five (5) months of a twenty nine (29) month contract with Maximus, Inc. commencing August 1, 2007 through December 31, 2007 for the provision of software maintenance and support, and optional fees.
This ordinance authorizes a supplemental appropriation of $262,960.00 from the unappropriated balance of the Franklin County Municipal Court Clerk computer fund; authorizes and directs the Franklin County Municipal Court Clerk to enter into the next twelve (12) months of a twenty nine (29) consecutive month contract with Maximus, Inc. commencing January 1, 2008 through December 31, 2008 to be paid on a quarterly basis for the provision of software support in the amount of $237,960.00 and optional services in the amount of $25,000.00 for the Municipal Court Clerk case management system. The optional services are for monies needed in the event that additional services are required for the case management system.
Bid Information:
Pricing was negotiated between Maximus, Inc. and the City Attorney's office on behalf of the Franklin County Municipal Court Clerk. Due to the proprietary rights per terms of contract # 18848 pursuant to ordinance 2807-97 approved by Council on 11/24/97, the software support was provided from the sole source provider, Maximus, Inc.
Fiscal Impact: Funds are available within the Municipal Court Clerk 2007 computer fund.

Whereas, this ordinance will enable the Clerk to appropriate said funds within the unappropriated balance of the Municipal Court Clerk computer fund; and
Whereas, sufficient funds are available within the Municipal Court Clerk computer fund; and
Whereas, that ordinance 2807- 97 on November 24, 1997 authorized the Franklin County Municipal Court Clerk to contract with Maximus, Inc. formerly known as Crawford Consulting, Inc. for the installation of CourtView 2000, the Franklin County Municipal Court Clerk case management system in accordance to sole source provisions, section 329.07; and
Whereas, the first five (5) months of the 29 months of the software support, contract EA 006734 ends December 31, 2007; and
Whereas, it is necessary to secure the next twelve (12) months of twenty nine (29) months of software support and optional services for the period of January 1, 2008 through December 31, 2008 for the Franklin County Municipal Court Clerk and Court case management system ; and
WHEREAS, it is in the best interest of the City and the Clerk to enter into said contracts in accordance with the sole sources provisions of Section 329.07 of the Columbus City Codes due to the proprietary rights of Maximus, Inc. formerly known as CCI-Maximus, the installer and software owner of CourtView 2000, the Franklin County Municipal Court Clerk case management system; and
Whereas, an emergency exists in the usual daily operation of the Municipal Court Clerk's office, in that it is immediately necessary to provide for ongoing and uninterrupted software support for the Franklin County Municipal Court Clerk case management system, thereby preserving the public health, peace, property, safety, and welfare; now therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Franklin County Municipal Court Clerk be and is hereby directed and authorized to enter into the next twelve (12) months of a twenty nine (29) month contract with Maximus, Inc. to be paid on a quarterly basis for the CourtView 2000 software support and optional services.
Sections 2. That from the unappropriated monies in the Franklin County Municipal Court Clerk computer fund and from all monies estimated to be deposited into said fund, the sum of $262,960.00 be and is hereby appropriated within the Municipal Court Clerk computer fund 227, subfund 02, organization 2601, oca code 260208, object level 1- 03, object level 3 - 3369 - $237,960.00, object level 3 -3347 - $25,000.00.
Section 3. That for paying the cost thereof the sum of $262,960.00 or so much thereof as may be needed is hereby authorized to be expended from the Municipal Court Clerk computer fund, fund 227, department 2601, subfund number 02, oca code 260208, object level 1- 03, object level 3 - 3369- $237,960.00, object level 3 - 3347 - $25,000.00.
Section 4. That the contract was awarded pursuant to the sole sources provisions of Section 329.07 of the Columbus City Codes; and
Section 5. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after if the Mayor neither approves nor vetoes the same.
